She concluded that removing the project from CEQA __ <br /> review would expose the City unnecessarily to liabilities which <br /> could result from unforseen circumstances and would lose the <br /> benefit of more extensive public comment and scrutiny when the <br /> project is no longer in CEQA review. <br /> <br /> Mr. Henry Hatton, 3963 Fairlands Drive, stated that ways and <br /> means of water conservation could be imposed on developers without <br /> having a moratorium on construction, such as having two sets of <br /> pipes, one using recycled water for outdoors and the other for <br /> indoor use. Developers could also contribute to a fund for <br /> flooding bases so water from the ocean can be pumped in. <br /> <br /> Mr. Gary Purnell, 2472 Via de los Milagros, stated that the <br /> project would have an overall negative impact on the Valley and <br /> would contribute to more traffic and a greater need for more <br /> services. <br /> <br /> Ms. Terry Spraggins, 7024 Corte del Oro, indicated that she <br /> cannot support the Negative Declaration for the reasons mentioned <br /> earlier by Ms. Dennis. She expressed concern about the potential <br /> road that might go across Moller property to enter into the <br /> Ridgelands. She added that the open space should not be left in <br /> the hands of the homeowners but should be dedicated to the <br /> community for public use. <br /> <br /> Ms. Angelina Yen, 3603 Portsmouth Court, stated that an EIR <br /> would be necessary to preserve the environment and wild life in the <br /> area. She indicated that there should be a guarantee for future <br /> public access on the hiking trails. <br /> <br /> She then read a letter to the City Council from Ms. Diane <br /> Habener, 3624 Manchester Street, who was unable to attend the <br /> meeting. The letter expressed the necessity of having a full EIR <br /> completed before any development is considered, particularly <br /> addressing the effects the development would have on traffic on <br /> Foothill Road, on the wild life in the area, and on the Ridgelands, <br /> and requested Council to support an EIR for the project. <br /> <br /> In response to Ms. Dennis' comments on the over-crossing and <br /> the water line on Gold Creek, Mr. MacDonald stated that maintaining <br /> a water line would be different from building a public street and <br /> that if the water line on Gold Creek was considered, it would have <br /> a separate environmental review. With regard to the public <br /> agencies, he indicated that representatives from the Department of <br /> Fish and Game (DFG) went around the site with City Staff and the <br /> project engineer and agreed on the same mitigation measures. He <br /> added that the DFG would like to enhance a little pond by the creek <br /> near the quarry area as a potential tiger salamander habitat, which <br /> <br /> - 12 - <br /> 3-19-91 <br /> <br /> <br />
