304 <br /> <br /> It was moved by Mr. Butler, seconded by Mr. Tarver, that <br /> Resolution No. 91-110 be adopted, denying AP-91-4, the appeal by <br /> Twyla Murphy, thereby upholding the decision of the Planning <br /> Commission and approving Z-91-74, the application of CPS Pleasanton <br /> One/Mark Sweeney for design review approval to allow the <br /> installation of a 65-foot tall pole on which would be mounted six <br /> 48-inch tall by 14 inches sending and receiving antennas, the <br /> installation of one four-foot diameter roof-mounted microwave <br /> communication dish, and the construction of an eight-foot tall <br /> masonry wall in the parking area of an existing office and <br /> industrial building, located at 4440 Willow Road (Lot 31B of the <br /> Hacienda Business Park). <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 6b <br /> Ruby Hill Preannexation Agreement (SR 91:287) <br /> <br /> Mr. Mercer declared the public hearing open on the <br /> application. <br /> <br /> Mr. John Stein, Vice Mayor of the City of Livermore, thanked <br /> the City Council and Staff of Pleasanton for meeting with the <br /> representatives from the City of Livermore. He presented a letter <br /> indicating that Livermore's legal staff believes that the proposed <br /> Preannexation Agreement is, under California State Law, a <br /> California Environmental Quality Act (CEQA) project and, therefore, <br /> requires an Environmental Impact Report (EIR). The reasons for <br /> this position include the changes made on the Alameda County <br /> General Plan, the expansion of the area, the location of the <br /> project, and the project's inconsistency with the Pleasanton <br /> General Plan, as well as possible changes in the sewer and water <br /> systems and the school position. He indicated that the Livermore <br /> Council is recommending that Pleasanton delay approval of the <br /> Preannexation Agreement until an adequate EIR is done, as required <br /> by CEQA guidelines, and that the Pleasanton Council approve <br /> Option 3 of the Staff Report and join Livermore in challenging the <br /> County's approval of the Ruby Hill Final EIR, which the Livermore <br /> Council also finds inadequate. <br /> <br /> Ms. Becky Dennis, 838 Gray Fox Circle, stated that she cannot <br /> support the Preannexation Agreement, based on the current water <br /> situation and especially since Livermore has initiated its lawsuit <br /> against the County. She indicated that Pleasanton would be better <br /> <br /> - 8 - <br /> 7-16-91 <br /> <br /> <br />
