249 <br /> <br /> Ms. Tracy replied that Clause 18 of the contract, which was <br />signed in the 1960's, indicates that the State will deliver water <br />to the agencies if the water is available. <br /> <br /> Mr. Tarver pointed out that there is something wrong with the <br />system because the State and Zone 7 are allocating more water than <br />they have available. He asked Ms. Tracy if Zone 7 is doing <br />anything to allocate water to the three cities so that whatever <br />water one city conserves through a growth moratorium is not <br />appropriated by another city's continued growth. <br /> <br /> Ms. Tracy replied that Mr. Mun Mar's water policy was always <br />first-come first-served. She added that Zone 7 needs to establish <br />a "fair-share policy" that would allow a city to "bank" whatever <br />water it has not used for a given year for its own use'at a later <br />time. <br /> <br /> Mr. Tarver inquired what was the status of the Vineyard Avenue <br />pipeline that should have been constructed in 1988, based on the <br />General Plan. <br /> <br /> Ms. Tracy replied that the pipeline will cost $14 million, <br />instead of the originally scheduled $9 million. She indicated that <br />the Fiscal Committee is looking for funding for the project since <br />most of the money has been used for other projects. <br /> <br /> Mr. Robert Cordtz, 262 West Angela, commended the Staff for <br />its water reports. He stated that the long-termcontracts between <br />DWR and the water agencies can be modified every five years, and <br />inquired if these contracts have ever been modified. He stated <br />further that the City of Pleasanton entered into an agreement with <br />Zone 7 for a treated water supply. He pointed out that there is a <br />breach of contract because Pleasanton is not receiving treated <br />water. <br /> <br /> Mr. Roush replied that the City Attorney's Office and the <br />Public Works Department are currently having discussions with <br />Zone 7 representatives with respect to some of the terms of the <br />contract. He stated that there appears to be no grounds, at this <br />point, to bring any kind of action for breach of contract. <br /> <br /> Ms. Acosta added that the City has begun discussion with the <br />Zone 7 Staff on renegotiating the contract. <br /> <br /> Ms. Mohr inquired if there were any way of verifying if the <br />City is receiving treated water. <br /> <br /> Ms. Acosta replied that the City's relationship with Zone 7 at <br />this time is confined to how much water the City is purchasing and <br /> <br /> - 8 - <br /> 6-18-91 <br /> <br /> <br />
