231 <br /> <br /> Ms. Scribner indicated that she was not opposed to limiting <br />the houses on the lots to one-story units but that she does not <br />support the Ordinance. <br /> <br /> Mr. Swift pointed out that Section 4 of the Ordinance should <br />indicate that the project not exceed 106 units rather than <br />"...construction of 102 new single-family residential units" <br />because Staff has not determined if the shortening of E Court would <br />delete four lots from the project. <br /> <br /> It was moved by Mr. Butler, and seconded by Mr. Mercer, that <br />Ordinance No. 1509 be adopted, approving the application of Shapell <br />Industries of Northern California for rezoning and development plan <br />approval, as filed under Case PUD-90-18, with the addition of <br />Condition No. 2c(14) that Lots 98-101 be limited to single-story <br />homes. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr and Mayor Mercer <br />NOES: Councilmembers Scribner and Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br />11.
