43 <br /> <br /> Mr. Roush requested some clarification on the language <br />regarding the mandatory water rationing options and if the council <br />intended to include such language in the growth management <br />agreements or only to this project. <br /> <br /> Mr. Butler affirmed that the wording in the growth management <br />agreements was correct as expressed by Mr. Roush and that the <br />language for the pre-annexation agreement is also correct, but <br />different. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Butler, that <br />Resolution No. 91-163 be adopted, (a) approving the pre-annexation <br />agreement as set forth in the Staff Report with the following <br />modifications, to be approved in final form by the City Attorney. <br />(1) Developer shall be permitted to construct 175 units in 1993 <br />and 175 units in 1994 as set forth in Paragraph 13, with the <br />balance of the units to be considered at the time growth management <br />allocations are made in 1992 and (2) the "Water Service" section is <br />to be amended to reflect that if the City has adopted a water <br />conservation plan or program in which the Developer participates, <br />Developer may be able to obtain building permits notwithstanding <br />mandatory water rationing in the City; (b) direct Staff to initiate <br />implementation of a Sphere of Influence amendment which would <br />include the entire 1,600 acre area; (c) initiating annexation <br />procedures using annexation Option 1. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Scribner, and Mayor Mercer <br />NOES: Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> 11.LEGISLATIVE UPDATE REPORTS <br /> <br /> There were none. <br /> <br />12.
