(A handout was given to Council
listing the building permit fees.) He explained that the applicant
was unable to pay at this time all of the fees listed ($110,530).

Mayor Mercer clarified Mr. MacDonald's request. Me indicated
the applicant would pay $750 per unit by April 1, 1992 and then pay
the balance when the building permits were issued.

Ms. Mohr asked if the applicants would lose the growth
management fee if they were unable to pay the building permit fees.

Mr. MacDonald answered yes.

Mr. Tarver asked when these units would be built.

Mr. MacDonald responded that they hoped to have this project
complete by the summer. They need to get their final map filed and
the bank loan approved.

Mr. Tarvet believed that the ordinance should remain the same
as introduced and the fees should be collected. If the applicant
was unable to pay the fees by April 1, 1992 then he would need to
come back through the Growth Management process.

It was moved by Ms. Scribner, and seconded by Mr. Tarver,
that Ordinance No. 1545 be adopted, amending Ordinance No. 1336, as
amended, and Section 17.36,230 of the Pleasanton Municipal Code, as
amended, concerning lapsing of Growth Management approval.

2/4/92
26
