181

Mayor Mercer asked if there was an appeaI period on this item.

Mr. Swift answered yes. Council has fifteen days to appeal
the decision made by the Planning Commission. He pointed out that
this item was listed in the staff report for Item 7a, Actions taken
by the Zoning Administrator, Desiqn Review Board, and Plannin~
Commission (UP-92-33).

Mr. Tarver indicated that he intended to appeal the decision
when the item was heard.

6. PUBLIC HEARINGS

Item 6a
Review of Rate Adjustment for Refuse Collection (SR92:320)

Mr. Mercer declared the public hearing open on the matter.

Martin Inderbitzen, Attorney at Law, 5000 Hopyard Road,
representing Pleasanton Garbage Service, thanked the Council sub-
committee and the staff for the work on this matter. He had no
need to add any comments to the staff report and stated that he was
available to answer any questions.

Ms. Mohr askedMr. Inderbitzen to explain the senior discount.
She also asked him to explain how the senior discount will apply to
the 90 gallon cans for new service.

Mr. Inderbitzen referred to page five of the staff report. He
stated a senior discount applies to all of the rates.

Ms. Mohr asked if a senior would receive the $8.31 rate when
the new 90 gallon rate starts.

Mr. Inderbitzen did not believe so. He stated that a senior
would receive the 90 gallon automated can rate. There is a senior
discount rate for a 30 gallon can because presumably the senior
would produce less garbage.

Ms. Mohr stated that the senior citizen who is new to the City
would not have the choice of having a 30 gallon can at the $8.00
rate. She felt that Council should discuss the price of size of
can. She stated that the 60-gallon can rate is less than the 90-
gallon can. She understood that those people using 60-gallon can
or less are paying the 90-gallon fee and are essentially
subsidizing the people that fill and/or overflow their 90-gallon
cans. She believed that the person who uses a 60-gallon can should
pay less than the person who uses a 90-gallon can.

8/ s/92 3
