130 <br /> <br /> It was moved by Ms. Mohr, that Ordinance No. 1570 be <br /> introduced, to be read by title only and waiving further reading <br /> thereof, approving PUD-92-4, Miriam Chu and Max Gahrahmat, with the <br /> following conditions: directing'developer to work with staff to <br /> reconfigure Lots 86, 87, and 88, accessing them from new street; <br /> bulb to be designed to City standards; and access road brought in <br /> as necessary to meet the need for park servicing and emergency <br /> access. <br /> <br /> The motion died for lack of a second. <br /> <br /> It was moved by Mr. Butler, and seconded byMs. Scribner, that <br /> Ordinance No. 1570 be introduced, to be read by title only and <br /> waiving further reading thereof, approving PUD-92-4, Miriam Chu and <br /> Max Gahrahmat, changing the access of Lot 86 to be from new street. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Tarver <br /> ABSTAIN: None <br /> <br /> Item 6d <br /> AP-92-10/V-92-7, Michael D. 8ohibler <br /> ~ppeal of the decision of the Planninq Commission denyinq an <br /> application for a variance from the Municipal Code to reduce the <br /> r%quired fence setback for a street side yard of the residence <br /> located at located at 4298 Fairlands Drive. Zoninq for the <br /> p=0perty is R-1-6500. (SR92:290) <br /> <br /> Michael Schibler, 4298 Fairlands Drive, explained that he was <br /> building a retaining wall with a fence above that around the side <br /> of his home which is on the corner facing the street. The problem <br /> that staff had indicated to him was that the wall was too close to <br /> the sidewalk at most points and does not meet a five foot set back. <br /> He was now applying for a variance. He explained that the wall <br /> meets code standards but the fence is 5 1/2 feet high and is built <br /> above the wall. The fence height and the wall height equal eight <br /> feet. He stated that the City code addressed the fence and wall <br /> separately. Mr. Schibler explained that by moving the fence back <br /> an average of 11 1/2 inches would not change the affect of the <br /> appearance but would create a lot of work. He did not believe that <br /> this fence and wall would create a tunnel effect. (Photos were <br /> given to Council of the property and the construction in place). <br /> He said that he had planned to landscape this area as soon as it <br /> was completed and he described the types of plants that would be <br /> used. A petition in Mr. Schibler's favor was also presented to <br /> Council. The reason he wanted this wall and fence was to increase <br /> his privacy, allow for a "dog run" along the side of his home which <br /> is closest to the street, and decrease the noise from the street <br /> traffic.
