137

Mr. Tarver declared the public hearing open on the
application.

Joseph Callahan, Callahan Property Company, was available to
answer any questions that Council might have. He reiterated the
proposed changes and that his objective was not to reduce costs by
making changes of this nature.

Robert G. Cordtz, 262 W. Angela, spoke in favor of this
project.

Mr. Pico believed that this is a major modification to the
project. He was concerned with the elimination of the landscaping
in the middle of the project. He suggested placing large planter
boxes throughout the area. He felt that it should go back to staff
or the Planning Commission for further review.

Ms. Scribner disagreed withMr. Pieo's opinion. She believed
that this was a minor modification to the project. She was glad to
see that the errors were caught. She asked that staff find a
solution to catching these types of problems.

Ms. Mohr agreed that it was unfortunate that this error
occurred but, she still believed that the project should be
approved before it is lost.

Ms. Dennis was concerned with this agreement being adhered to.
This error/problem gives an opportunity to look at the ordinance
and new establish rules. Mayor Tarvet agreed.

It was moved by Ms. Scribner, and seconded by Ms. Mohr, that
Ordinance No. 1592 be introduced, to be read by title only and
waiving further reading thereof, approving the application of
Joseph W. Callahan for a minor modification to the approved
development plan for Palomino Place as filed under Case
PUD-90-10-2M; subject to the following conditions, 1) building
exterior changes and landscape plan modifications shall conform
substantially to the revised elevations and site plan, Exhibit A,
on file with the Planning Department, except as modified by these
conditions, and 2) except as modified by Conditions 1 and 2, all
conditions of Cases PUD-90-10 through PUD-90-10-1M shall remain in
full force and effect.

The roll call vote was as follows:
AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor
Tarver
NOES: None
ABSENT: None
ABSTAIN: None

Ms. Scribner asked that a clarification be made from staff
regarding the what constitutes a major and minor modification.

4/6/93 9
