49 <br /> <br /> Mr. Swift explained that the intent in all reimbursement agreements that the City enters <br />" into is that the reimbursement is triggered by the development of the property. If the property <br /> were to be subdivided that would be the trigger for the reimbursement agreement. There would <br /> be no reason to do a subdivision without being part of a development plan for either one of the <br /> lots. It's likely that the Ix'by and Caplan property would develop in a commercial manner <br /> without a subdivision. Mr. Swift explained the reimbursement and subdivision sections of the <br /> agreement. <br /> <br /> Mr. Elliott explained that this is an improvement to the water distribution system that the <br /> City anticipated before this development. This water main will also be a benefit to the Kaufman <br /> and Broad project therefore an agreement was made to split the cost for it. <br /> <br /> There was general discussion on the benefit of having this water main. <br /> <br /> Mr. Irby did not object to the agreement as presented. <br /> <br /> It was moved by Ms. Scribner, and seconded by Ms. Dennis, approving the <br /> Reimbursement Agreement regarding California Reflections, Tract 6545, Kaufman and Broad. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Mohr and Scribner <br /> NOES: Mayor Tarver and Councilmember Pico <br />· ABSENT: None <br /> ABSTAIN: None <br /> <br /> 7.
