49

Mr. Swift explained that the intent in all reimbursement agreements that the City enters
" into is that the reimbursement is triggered by the development of the property. If the property
were to be subdivided that would be the trigger for the reimbursement agreement. There would
be no reason to do a subdivision without being part of a development plan for either one of the
lots. It's likely that the Ix'by and Caplan property would develop in a commercial manner
without a subdivision. Mr. Swift explained the reimbursement and subdivision sections of the
agreement.

Mr. Elliott explained that this is an improvement to the water distribution system that the
City anticipated before this development. This water main will also be a benefit to the Kaufman
and Broad project therefore an agreement was made to split the cost for it.

There was general discussion on the benefit of having this water main.

Mr. Irby did not object to the agreement as presented.

It was moved by Ms. Scribner, and seconded by Ms. Dennis, approving the
Reimbursement Agreement regarding California Reflections, Tract 6545, Kaufman and Broad.

The roll call vote was as follows:
AYES: Councilmembers Dennis, Mohr and Scribner
NOES: Mayor Tarver and Councilmember Pico
· ABSENT: None
ABSTAIN: None

7. REPORTS OF THE CITY ATFORNEY

There were none.

8. LEGISLATIVE UPDATE REPORTS

Item 8a
State Budget Update (IR93:46)

This item was continued to the June 1, 1993 Regular City Council meeting.

9. CITY COUNCIL CALENDAR

The Calendar was reviewed and no changes were made.

05/18/93 13
