14 <br /> <br /> Mr. Elliott, Director of Public Works, indicated that if the remnants are removed <br /> it would allow the 100 year flood to be lowered by .2 of a foot. With that removal, these <br /> homes would be taken out of the 100 year flood plain. The removal of this material is <br /> estimated to cost $90,000 and Zone 7 is not willing to remove the debris. He added that <br /> the removal of this debris could be included in the next Capital Improvement Program, <br /> but unfunded. <br /> <br /> There was discussion of sharing the cost between perhaps Zone 7, the City, the <br /> developer and the homeowners. <br /> <br /> Mr. Summers pointed out the difficulty in obtaining permits for the removal of the <br /> abatement from the Arroyo. <br /> <br /> Mr. DeSilva indicated that there was no relationship between the removal of the <br /> abatements and his project. He was willing to participate in studying the removal and if <br /> possible he will pay a share in the cost but he would need full participation of the City <br /> as well. <br /> <br /> Mayor Tarver said that he will be writing to Zone 7 regarding this matter to get <br /> a better understanding of the problem. <br /> <br /> Joseph Cunningham, Valley Trails resident, described the debris and the problem <br /> it has caused. (Pictures were provided to Council). <br /> <br /> Chris Wood, 7816 Foothill Knolls Drive, Vice-President of Foothill Knolls <br /> Homeowners Association, spoke in favor of this application as presented. <br /> <br /> There being no further testimony, Mr. Tarver declared the public hearing dosed. <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Resolution No. 93- <br /> 53, be adopted, approving the application of the DeSilva Group for a minor modification <br /> to the approved development plan for Laguna Oaks as filed under Case No. PUD-89-5- <br /> 2M, to include the Growth Management conditions in the DeSilva proposal (30 in 1993 <br /> and 60 in 1994, Alternate B), in a form as approved by the City Attorney. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> 05/04/93 <br /> <br /> <br />
