Ms. Ayala said if the voters are not comfortable with the plan for the bypass road <br />and water and sewer infrastructure financing, they can vote against the annexation on <br />November 16th. <br /> <br /> Ms. Seto said that was correct and explained that a majority vote in favor of the <br />annexation would be needed for the plan to go forward. <br /> <br /> Mayor Tarver asked if anyone else wanted to address this issue. <br /> <br /> Craig Champion said there is only one issue that is holding up the PUD application <br />and that is the soils peer review, which has been in process for four months. He stated they <br />are doing everything they can to get it completed. If the report is not done soon enough, he <br />asked if the project could be processed on a dual track. <br /> <br /> Mayor Tarver said Council was beyond that item and are currently talking about the <br />annexation vote. <br /> <br /> Mark Armstrong, on behalf of the Spotornos, asked for clarification of the motion. <br />Summerhill has a contract with the Spotornos. He assumed the development agreement <br />process would engage the property owners as well as the developers. <br /> <br /> Mayor Tarver said it would. <br /> <br /> An unidentified speaker felt that the special election should also include the <br />homeowners affected by the development included in the agreement. Happy Valley voters <br />would be determining the fate of the Pleasanton residents affected by developers in areas <br />that would significantly affect them. <br /> <br /> Mayor Tarver appreciated the point, but the process allows Council to make <br />decisions on what it will do when it gets to that point. It would not be on the November <br />election. Referendums are always possible. If the community objects to any part of this, <br />the residents can deny a particularproject by referendum. <br /> <br /> Ms. Ayala explained that the application by New Cities has not been heard by <br />Council yet, so the neighborhood still has an opportunity to speak to Council. If the <br />neighbors are not happy with the Council decision, they have the referendum process. <br />Happy Valley residents are not dictating to them. <br /> <br /> Unidentified speaker said they are if the vote for annexation and the deal has been <br />made to give the bypass road in exchange for guaranteed development. The developers <br />want to say, "Here is $1.2 million, now let us do what we want."
