Mr. Swift said the draft agreement presented by the developers includes a provision <br /> that if 160 units are not approved, the developers would get a prorata reduction in the <br /> amount they pay for the infrastructure, and would not pay $1.2 million. That is how they <br /> attempted to protect themselves. They would give the City all the discretion Council <br /> normally has in reviewing a PUD, but at the same time they were protecting the amount <br /> they would pay for the water and sewer. <br /> <br /> Ms. Michelotti did not think the motion on the table would accomplish what <br /> Council was trying to do. The agreement would allow each funding developer to build on <br /> its property consistent with the Specific Plan and development criteria including <br /> construction of the bypass road by New Cities and Summerhill. This motion is setting up <br /> something that cannot be accomplished. Whereas the original agreement at least guarantees <br /> the bypass road will be there and the developers had some expectation, but not in concrete. <br /> <br /> Mayor Tarver said the development agreement staff will be pursuing will nail down <br /> the details about the bypass road, whose constructing it, where the sewer and water is <br /> coming from and as much detail of the PUD as is humanly possible to accomplish before <br /> such time as we need to act on it. <br /> <br /> Ms. Michelotti asked why Mayor Tarver didn't make a motion like that. <br />'-- Mayor Tarver called for the question. <br /> Ms. Ayala felt that the developer will bring in the very best plan it can. <br /> <br /> Ms. Michelotti asked what the difference was in the current proposal and what staff <br /> is doing. <br /> <br /> Ms. Acosta said staff does not know how the plan will turn out. They will discuss <br /> the details with the develops. One difference is process; having the PUD at the same time <br /> as the development agreement. The other is having the developers construct the water and <br /> sewer lines.
