Ordinance No. 1787, to be read by title only and waiving further reading thereof, <br />amending the Pleasanton Municipal Code; and to adopt Resolution No. 99-118, <br />amending Pleasanton's Master Fee Schedule concerning regional and local sewer user <br />rates and charges. In addition, staff is directed to make the request that the funds <br />collected be accounted for separately until the financing plan is complete and there <br />are specific numbers for the costs itemized on the list. <br />The roll call vote was as follows: <br />AYES: Councilmembers- Ayala, Dennis, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Mr. Tarver stressed that he believes these fees to be interim and will be reviewed <br />further as the LAVWMA financing options are discussed. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Dennis, to continue the <br />meeting to deliberate on the remaining agenda items. <br />The roll call vote was as follows: <br />AYES: Councilmembers- Ayala, Dennis, Michelotti, Pico, and Mayor Tarvet <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 6d <br />Quarterly report regarding cable television Franchise Renewal Process. (SR 99:259) <br /> <br /> Nelson Fialho presented the staff report. <br /> <br /> Ms. Ayala asked if $608,000 was the total for the potential underpayment due to the <br />four Tri-Valley cities. <br /> <br /> Mr. Fialho said there were two components: potentially, a franchise fee <br />underpayment of approximately $174,000; and the $608,000 that is potentially due to the <br />four cities, which relates to how TCI calculates revenues from the local business <br />community for advertising on the local cable system. There is case law that supports only <br />partial reimbursements to the franchise jurisdiction. Currently, TCI returns 30% of that <br />revenue and our consultant believes that it should be 100%. We still have to determine the <br />legal complexities. <br /> <br /> Mr. Tarvet encouraged communication with other cities in the same process or that <br />have already gone through the process.
