Mr. Swift said the North Sycamore Specific Plan had been approved and Mr.
Bozorgzad would build his house and ultimately subdivide the other three lots. When
Greenbriar entered the picture it provided a new east/west street, sewer and water lines,
etc. Mr. Bozorgzad had wanted to build his house on his lot at the top of the hill to get
utility infrastructure from San Carlos Way. With the connection of San Carlos Road, his
plan is still to build his house, however the development plan has to show where his lot
and future lots will be and how access will fit in relation to the overall scheme.

Ms. Ayala inquired about the location of the path and whether it was in front of
someone's house.

Mr. Swirl explained that as currently shown, the path would run along the edge of
the top lot on the Bozorgzad property. Whether it is in front, side or rear, depends on
how Mr. Bozorgzad chooses to design and locate his house. He felt the practical way to
build the trail in order to meet Mr. Bozorgzad's desires for his lot was to run the trail
down the property line, whether slightly on the Bach property or the Bozorgzad property,
or both. If the Bach property is subdivided in the future, then the large parcel becomes
two and a street of some sort would be extended further up the hill to provide access to
the upper lot and the path connection would be much shorter. However it is unknown
how the Bach property will subdivide.

Mr. Tarver asked for a suggestion regarding Condition #8 to say the construction
of the pedestrian path will be in conjunction with the issuance of the first building permit.
His only concern was that the path be constructed soon. He was not concerned about the
design or location at this time.

Mr. Swift thought it was the Mayor's desire to have the path constructed in
conjunction with the first building within the PUD and the final design and configuration
of the path will be shown in conjunction with the design review for the first house. That
would put off the final design and location of the path until there is an actual house plan.
It would be good if it was in conjunction with Lot 4. If, however, the first house was on
the PUD-A lot, it doesn't make as much sense.

It was moved by Mr. Pico, seconded by Mr. Tarver, to require the design and
construction of the pedestrian connector to be done in conjunction with the building
permits and design for the first property to be developed on the Bozorgzad property
and that the actual location and design of the pedestrian walkway be determined at
that time.

Mr. Bach indicated he was given assurance by the City that this would not have to
happen until his property was developed. He has rural property and the Specific Plan
clearly states that when an urban issue conflicts with an agricultural issue, the agricultural
issue will prevail and be protected. Now Council is proposing to allow 600 feet of access
of city kids to his horses. He did not understand how this could happen. He would have
spent time rallying support if he had thought this would happen.

16 09/20/99
Pleasanton City Council
Minutes
