properties. Through all the negotiations with Greenbriar, they were assured there would
be a pathway that cuts through. She did not like having construction starting at 8:00 a.m.
on Saturday. She felt it was very disruptive. She also believed the house design should
be reviewed by the Planning Commission. This is a very large house that is out of
character with the area. She believed it was to be approximately 7,000 sq. ft. She felt
that many of the people supporting this application will be leaving in the future because
the area will have changed from a rural environment. However, she and her neighbors
plan to stay.

Mr. Bozorgzad agreed the pedestrian pathway has been a point of discussion since
he bought the property. He has also wanted a better understanding of that dotted line. At
the beginning, neighbors on San Carlos did not want the access and staff felt that by the
time the plan is approved it might be possible to have it removed. As the Greenbriar
project was developing, staff suggested he file an application to have the path removed,
which he did. He was told to contact the neighbors on San Carlos and Sycamore to
determine what they wanted. Most people signed a petition to say they did not want it.
He did not talk to people on San Juan Way. Six months later there was a neighborhood
meeting and none of the people who signed the petition attended, but many who lived on
San Juan Way wanted the path and did attend. He withdrew his application to remove
the path. He discussed privacy issues with his path and then talked to the planning staff
to find a way to relocate the path. He talked to Mr. Bach about the location of the path.
Mr. Bach had concerns about people walking by his horses and the 600 ft. easement.
Other locations were explored and a compromise was reached. He described the current
proposal. He feels he has done everything he can to deal with the neighbors' concerns
and has even rotated his house 180 degrees to give more privacy to satisfy his wife's
concerns. This is a good process, but unfortunately it sometimes pits neighbor against
neighbor. He agreed to construction on Saturday, from 9:00 a.m. to 3:00 p.m. so people
do not get wakened early. But he did need to have construction on Saturday. With
regard to house design review, he assured Council his house would not be bigger than
necessary for his family. He has never planned to have a 7,000 sq.ft. home. His current
plan is about 5,000 sq. ft. The FAR would allow 7,000 sq. ft. but he has never planned
that. As far as plan review, he said notice would be given to neighbors so they have a
chance to review the plans. He was just concerned about any more delays.

Ms. Michelotti asked about the timing for development of the other lots in this
PUD.

Mr. Bozorgzad indicated he had no immediate plans for that. He said if the
Greenbriar plan had not been approved, he would not have subdivided his lot, he would
only have built his residence.

Ms. Ayala asked why he changed his mind.

Mr. Bozorgzad said staff recommended it because his property would get services
from the new infrastructure and not from San Carlos Court.

12 09/20/99
Pleasanton City Council
Minutes
