Brian McGuire, 233 Del Vale Court, was concerned how this initiative would affect his <br />property. His property was annexed as low-density residential in the Vineyard Corridor. His <br />property is not connected to Ruby Hill or the Vineyard Corridor, yet his property is subject to the <br />same rules and regulations. He felt this was wrong and has brought this before the Council <br />previously. He sat on the committee for the General Plan, which took three years to develop. He <br />said now people want to overturn the General Plan with this initiative. The initiative will severely <br />affect his property, among others. He did not think development of his property should be subject <br />to the vote of the people. It is his property to do with what he wants. He was very frustrated over <br />what has happened to him. He said this is wrong. The initiative represents the efforts of a group of <br />people who are frustrated, but it has gone too far. He does not want the General Plan changed. He <br />felt the initiative would only create problems and the City would end up with development that is <br />not appropriate. He believed this initiative was not going to accomplish what the people wanted. It <br />will not change the traffic, or increase the water supply, or support new schools. He had several <br />questions. What is the financial impact; what are the legal ramifications; what is the City's liability? <br />He said the General Plan is a good plan. The answer is to take the remaining areas and assure that <br />appropriate development takes place. He did not want to leave it up to the hands of Madison <br />Avenue to decide; let the elected officials decide. <br /> <br /> Steve Garrett, 2291 Via De Mercados, Suite E, Concord, understood there might be <br />debate on the disposition on the remaining growth allotments pending the decision tonight. He <br />is the owner of an already approved project within the City, approximately 29 homes, and it has <br />been processed with good faith over the last two years. Considerable time and money have been <br />invested in this project. He hoped, regardless of the decision, it would not slow down the process <br />and they would be allowed to continue. He said the initiative needs careful consideration. He <br />would not place it on the ballot as a Council initiative. A combination of things makes new <br />development projects successful or not successful. He believed ballot box planning was not the way <br />to develop a project. There needs to be input from the neighbors, the community and all of those <br />involved. He said during the process of gathering signatures and placing this on the ballot there will <br />be time to debate and answer all the questions. <br /> <br /> Jack Hovingh, 4250 Muirwood Drive, said he did not want to see the Council sponsor an <br />initiative simply based on the Notice of Intent. He felt it would set a precedent. He encouraged the <br />Council to let the people gather signatures. <br /> <br /> There were no further speakers. <br /> <br /> Mayor Tarver said his desire was to get resolution of this issue as quickly as possible. If the <br />Council was going to set a special election it should be done as quickly as possible. Obviously, the <br />time needed to gather information and prepare a staff report does not allow this. If this can't go in <br />June with the referendum, he does not want to call for another special election. Nor does he want <br />to stop the process from going through the normal course of action. He would like a debate and <br />hear what the voters have to say about the initiative. He felt it was important to have a public <br />hearing, so people could express their concerns and the Council could tell the residents what they <br />have to do in order to do it right. He said the debate will be held and the community will be able to <br />vote. If there are unintended consequences from the initiative because of the way it is drafted, there <br />could be unintended results.
