Mr. Roush said the suggestion is a modification of Condition 1 and 2. He felt the input of <br />the applicant should be received. <br /> <br /> Mayor Tarver declared the public heating open. <br /> <br /> John Ford, Passport Homes, 7657 Highland Oaks Drive, said this project will provide as a <br />gift 90% of its land area to the East Bay Regional Park District. The purpose of this gift is to <br />protect valuable Ridgelands. This project will protect those lands in perpetuity. He said the project <br />will not be visible from Pleasanton. Also Passport has signed the fixed fee agreement and will be <br />paying its full share to mitigate any impact the project has on schools. An additional condition will <br />be required due to concems regarding current enrollment at Lydiksen School. Option Number 1 <br />which calls for a restriction on occupancies until Case Avenue school is completed, is an option <br />Passport Homes can live with. Passport' s preference is Option Number 2. Option Number 2 would <br />provide for a time frame that would preclude the occupation of homes until after the projected <br />completion of Case Avenue school. A custom home will require, at a minimum, nine to twelve <br />months to build. It is highly unlikely that all six homes will start construction at the same time. It <br />would be expected that one to two homes would start construction in January and be completed in <br />September 2000, just after Case Avenue school completion. The balance of the homes would be <br />started and completed four to six months beyond the completion of the school. The third option <br />presented tonight would be difficult. He does not see the connection between lot sales and school <br />enrollment. He believed that the time frames are appropriate. He urged Council to consider the <br />benefits of the project very carefully. He said Dr. Panganiban has cooperated with the City by <br />granting roadway easements and allowing two acres of his property to be used for construction of a <br />nearby water tank. Please consider that the 55 acres of ridgeland will be protected forever and that <br />one tree will be lost due to the project. Please consider the various design elements of this project <br />that meet the special challenges for developing in the hills. He asked for Council's support in <br />approving this very unique project. <br /> <br /> Ms. Ayala understood that the Mayor' s suggestion was not acceptable to Mr. Ford. <br /> <br /> Mr. Ford understood the Mayor' s option would exclude Passport from selling any lots until <br />after Case Avenue is complete, which would be more expensive and cause a considerable delay for <br />this small six unit project. <br /> <br /> Mayor Tarver explained the applicant could request changes to conditions based on <br />circumstances or situations. The Mayor wanted to know the school is going to open and does not <br />want staff to be hit with six people who bought lots and want building permits and can not get <br />them. He is trying to figure out a way to accomplish the objective of having Case Avenue open <br />before there are children in the houses. He would like to be assured that no more houses are built <br />when there are no schools to accommodate new students. <br /> <br /> Mr. Ford said at the March 13 meeting option one was considered.
