Adopt Resolution No. 99-029, objecting to County sale of tax defaulted property
(Kottinger Drive - APN 094-0021-011-00) and finding that the property is needed for
public use by the City of Pleasanton. (SR99:091)

f. Adopt Resolution No. 99-030, amending Resolution No. 99-020, to provide that persons
different than those who signed the primary arguments may sign the rebuttal arguments.
(SR99:87)

The roll call vote was as follows:
AYES: Councilmembers- Ayala, Dennis, Pico, and Mayor Tarver.
NOES: None.
ABSENT: CouncilmemberMichelotti.
ABSTAIN: None.

5. MEETING OPEN TO THE PUBLIC

Robert Cordtz, 262 West Angela, said on behalf of TNT the fence that was promised by
the Council is still not in place. He also mentioned that the City of Livermore Police and Fire
Departments are in the process of starting an operation lifesaver and will be upgrading the
railroad fight-of-way. He said the area had not been cleaned up and he had concerns about the
West Angela grade crossing.

Ms. Ayala asked if he felt there was a necessity for a fence.

Mr. Cordtz said absolutely.

Mr. Lum said there has been difficulty in installing the fence because the existing fences
are on the property line and the City is not allowed to encroach onto the railroad fight-of-way.
The City is in the process of meeting with each individual property owner to acquire access to
construct the fence.

Jack Hovingh, 4250 Muirwood Drive, objected to comments made in a newspaper article
by an elected official asking the City to pay for legal expenses in support of the Zone 7
initiative. As a taxpayer he objected to the City helping an initiative in a financial way. He did
not want to contribute taxpayers dollars to political initiatives. He also had a concem with the

Pleasanton City Council 2 03/24/99
Minutes
