It was moved by Mr. Pico, seconded by Ms. Scribner, to approve the annual baseline <br />traffic counts for 1994. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Mohr, Pico, Scribner, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br />11, CITY COUNCIL COMMITFEE REPORTS <br /> <br /> There were none. <br /> <br />12, REPORTS OF THE CITY ATTORNEY <br /> <br />Item 12a <br />Campaign Reaulations - Limiting. time for contributions. (SR 94:271) <br /> <br /> Michael Roush presented the staff report. <br /> <br /> Frank Brandes, Jr., 6889 Corte Sonada, commended Council for its interest in campaign <br />reform and full disclosure. Mr. Brandes asked if the time limit applied to when the money was <br />received by the candidate or the date of the postmark, if mailed prior to the seven day cut-off. <br /> <br /> Mr. Roush indicated there were two issues: when the contribution is made and when it <br />is accepted. The ordinance states no person shall make a contribution seven days prior to the <br />election, so using the postmark would be acceptable. The problem is if it is not picked up from <br />a post office box until six days before the election, that is the date of acceptance and it would <br />have to be returned to the contributor. <br /> <br /> Mr. Brandes indicated that is a concern. Many times checks are mailed to candidates and <br />by the time mail is received and a deposit made, it is possible the candidate would be in <br />violation of the ordinance. He believed the intent of the ordinance is good, but there are many <br />ambiguities and potential enforcement difficulties. <br /> <br /> Mayor Tarver indicated the intent is to provide disclosure, not limit receipt of funds. <br /> <br /> Mr. Brandes then requested clarification on "in-kind" contributions within the designated <br />time period of seven days before the election and sixty days after the election. <br /> <br /> Council then discussed various in-kind contributions or services, including the use of <br />volunteer services for handing out literature. <br /> <br />08/02/94 13 <br /> <br /> <br />
