Mr. Roush indicated that he was not aware of any pending litigation regarding this matter <br />but would look into the matter further. There may be a reason to have a closed session <br />regarding this subject at a later date. <br /> <br />Item 10a <br />Proposed Ordinance on Targetell R~idential PiCketing (SR94:20) <br /> <br /> Mayor Tarver explained that only residential picketing will be discussed, not the reasons <br />for the picketing. <br /> <br /> Mr. Roush presented the staff report. <br /> <br /> Mr. Pico asked how is it determined which residence is a targeted residence. He also <br />asked how the picketers will be managed regarding stopping in front of residences. <br /> <br /> Mr. Roush responded that the police department will be enforcing this ordinance. He <br />reiterated the intent of the ordinance is to prohibit picketing at a particular dwelling. In response <br />to Ms. Mohr's question, Mr. Roush explained that this type of ordinance apparen~y has been <br />effective in protecting the privacy and security of neighborhoods in other cities. <br /> <br /> Ms. Mohr inquired about any laws prohibiting picketing in or around schools. <br /> <br /> Ms. Acosta assured Council that there are current laws that prohibit the showing of <br />graphic material within a reasonable distance of a school. The police department has been <br />enforcing those laws. <br /> <br /> Chief Fastman described some of the difficulties and incidences that have occurred in <br />Pleasanton regarding picketing. He stated that there have been some occasions at Amador High <br />School where arrests have been made. There have also been problems with targeted picketing <br />in neighborhoods. <br /> <br /> Deborah Kleffman, Paseo Granada, represented the Country Faire neighbors. Ms. <br />Kleffman read the following petition to Council: Dear Mayor Tarvet and Pleasanton City <br />Councilmembers, we the undersigned are seeking immediate protection from protests in our <br />subdivision. We are residents of the Ponderosa, Country Faire, and __ developments. There <br />have been several recent anti-abortion protests/pickets in our subdivision. We take no stance <br />on the abortion issue. We wish to make it clear that by signing this we are neither endorsing <br />nor condemning abortion. The protestors First Amendment rights can be adequately protected <br />by allowing protests in other forms but banning picketing in residential areas. We are <br />particularly concerned about the following: 1) our children being exposed to offensive and <br />graphic pictures of aborted fetuses where they play; 2) our children being able to play and use <br />the sidewalks and <br /> <br />01/18/94 <br /> 3 <br /> <br /> <br />
