John Haman, Providian Bancorp, 4920 Johnson Drive, indicated Providian employs <br />approximately 800 people at this time and proposes to add several hundred more in the next few <br />months as it completes its third building. It is interested in doing its fair share to support the <br />community and to insure that Pleasanton has adequate parks and recreation facilities. They want <br />to provide a healthy work lifestyle for its employees and infrastructure for the city because it <br />makes them a more desirable employer. He had, however, a couple of issues with the proposal. <br />First, there was a matter of fairness. He had to agree to the condition or his company would <br />not have been given the permits to build. Existing business that are not expanding seem not to <br />have this obligation, whether their employees will use the parks or not. He felt there was <br />inconsistency. All businesses should pay their fair share, not just new businesses. His second <br />issue was how staff can determine the percentage of employees using park facilities, when the <br />location of the new park is not determined. If the park was across the street from his business, <br />they might be willing to pay more, but if it is in the south end of Pleasanton, he did not believe <br />he should pay as much because there would not be the same mount of usage. In summary, <br />Providian will pay its fair share, but felt all businesses should contribute and further <br />consideration should be given to who is actually using the park. <br /> <br /> Ms. Dennis thanked him for his comments, _because she has shared them. She was happy <br />to see those comments coming from the business community. <br /> <br /> Jeff Brimton, Brobeck, Phleger & Harrison, One Market Plaza, San Francisco, <br />representing AT&T, indicated it had only become aware of this proposal last Friday. Because <br />of late notice, he asked for a delay in Council action to review the proposal and give him a <br />chance to respond. <br /> <br /> Ms. Acosta indicated staff had notified the property owner many months ago and is not <br />sure what happened. <br /> <br /> Mr. Bfinton was aware Brian Swift had communicated with the property owner, but there <br />was a lack of communication with AT&T. <br /> <br /> Chris Kinzel, 7741 Oak Creek Court, owner of TJKIVI Transportation Consultants, <br />indicated he is not likely to move his business regardless of what Council decides about the park <br />fee. He supported the staff recommendation. Because of his business, he is very sensitive to <br />traffic in Pleasanton and inspile of the growth in the last few years, there are no intersections <br />that are at unacceptable space levels and none are expected. He believes most of the reason the <br />traffic system works so well is because of improvements funded by the business community. <br />Even though the improvements are designed to accommodate residential and business traffic, <br />most residents have not paid direc~y or indirec~y for the hundreds of millions of dollars of <br />improvements. His point is that business has already contributed grea~y to the needs of the <br />community and one more fee is not a good idea.
