Ms. Michelotti felt we may be dealing with the reality of companies not being able to do <br />projects. She thought that if the developer does not participate in one of these programs or <br />simply does not perform, that the developer loses its allocations and must come back in line for <br />new allocations. The concept of the revised growth management program was to allow those <br />people who are ready to go ahead and be accommodated. <br /> <br /> Mr. Tarvet hoped that would be the people who had allocations for past years, not the <br />new people. It would be nice to sit down in 1996 and talk about real projects and not deal with <br />custom lots and others that don't have projects ready to build. <br /> <br /> Fred Bates, 34145 Mallard Court, Monterey, principal in New Cities Development <br />Group, indicated he has three projects subject to tonight's hearing: Walnut Glen Estates, St. <br />Johns Place, and Vintage at Hansen Park (better known as the Del Prado school site). He had <br />a couple of questions to staff. What happens on a reservation (for Del Prado)? Would he have <br />to walt until the end of 1996 to determine if 750 permits had been pulled to see if he can pull <br />permits? <br /> <br /> Mr. Swift indicated the reservation concept for that project was for Council to select a <br />year in which to grant growth management approval for the project, once the developer submits <br />a formal application. It could be done as early as February or as late as August. The <br />reservation is a place holder for the project once it made its formal application at the appropriate <br />time. <br /> <br /> Mr. Bates then asked if he were granted allocation in February, would he have to go on <br />a waiting list. <br /> <br /> Mr. Swift said no. If Council grants you an allocation for 1996 and approves the project, <br />then you build it in 1996 or ask for a different year. <br /> <br /> Mr. Pico then asked that if the developer were given a reservation for 1998, would the <br />developer have the fight to request to build earlier. <br /> <br /> Mr. Swift indicated the developer would still make the formal request in February and <br />if a developer in 1996 moves out, then Mr. Bates could move into the vacant space. <br /> <br /> Mr. Tarvet asked if this was a first-come/first-served process or does a developer have <br />to wait in the reservation line until the end of the year, because no one is letting go of their <br />allocations. What is the legal issue surrounding limiting the number of permits in a year once <br />you have reached the 750th unit? <br /> <br /> Mr. Roush indicated the way the program is set up is that the City could issue more than <br /> 650 or 750 permits in a given year because the General Plan says you cannot approve more than <br /> 650-750 units for new projects. But the figures we are dealing with, the 782 for example, is <br /> <br />12/04/95 -13- <br /> <br /> <br />
