Ms. Mohr clarified that the City would send a letter to the operator or the Fair Board <br />stating that they had to come in for a conditional use permit to resolve the lighting problem. <br /> <br /> Ms. Michelotti did not think this land use issue and disputes with the fairgrounds were <br />on the agenda. It is related to the lights issue, but she thought that these are different issues. <br /> <br /> Mayor Tarver stated that the information report is not sufficient for him on the issue of <br />the lighting. He felt this was not being handled properly. <br /> <br /> Ms. Michelotti stated that this had been a topic of discussion in the liaison meeting and <br />felt there was more than one perspective. <br /> <br /> Ms. Dennis' main concern about addressing this in an informational way was whether <br />it might be precedent setting in any way for what is done in the future. <br /> <br /> Mr. Roush commented that the Council did not waive its land use authority simply <br />because it chooses to not enforce it in a particular situation. <br /> <br /> Mayor Tarver stated that this is an information report. What would be the proper <br />mechanism for the operator of this course as it relates to putting up lights in the City of <br />Pl~_~nton. If it was in downtown Pleasanton in a sports park, what would they have to do to <br />put up lights in Civic Park. <br /> <br /> Mr. Roush stated that the City would look at the zoning ordinance and from that deride <br />whether or not a person needed a conditional use permit or some other type of permit. The code <br />enforcement officer would contact that person and inform him that he would have to go through <br />a process. <br /> <br /> Mayor Tarver stated that is what he would like staff to do; the same process that would <br />be used for any other property owner in the City of Pleasanton. There will be notice to the <br />public. <br /> <br /> Ms. Mohr replied that rather than having the code enforcement officer carry this <br />message, and in view of the sensitivity of our relationship with the Fairgrounds and our efforts <br />to make it work better and be more cooperative, she suggested the Liaison Committee as the <br />entity to inform the Fair Board. <br /> <br /> Fred Itempy, 7647 Cottonwood Lane, applauded Mayor Tarver for feeling almost as <br />strong as he does about this issue. The fairgrounds had not been a good neighbor. The Rose <br />Avenue area is like the land that time forgot. The property owners in that area have finally <br />gotten together and have a unified plan which Council should receive this spring. The residents <br />first noticed the lighting when the streets were lit and young couples no longer parked or parried <br />in that area. The residents were pleased because it felt like security lights were installed. But, <br />now the issue is how the residents are affected and what this will do to the property values when <br /> <br />11/28/95 -10- <br /> <br /> <br />
