(6) Incompetence. Incompetence shall mean want of <br /> ability suitable to the work, either as regards <br /> natural qualities or experience or deficiency of <br /> disposition to use one's ability and experience <br /> properly. <br /> <br /> (7) Through willful misconduct, causing damage to <br /> public property or waste of public supplies. <br /> <br /> (8) Being, or having been at the time of employment, <br /> subject to any of the disqualifications described <br /> in the City Personnel Rules, and having willfully <br /> concealed or misrepresented facts in his/her <br /> application for employment. <br /> <br /> (9) Insubordination. Insubordination shall mean that <br /> the employee, having then the ability to do a <br /> reasonable act which he/she is directed to do by <br /> any officer or employee of the City with authority <br /> to direct his/her activities on the job, willfully <br /> fails or neglects to perform the directed act. <br /> <br /> (10) Disrespectful or discourteous conduct toward a City <br /> officer or official, another employee, or a member <br /> of the public. <br /> <br /> (11) Willful violation of any of the provisions of the <br /> City Ordinances or Resolutions relating to the <br /> conduct of City officers and employees. <br /> <br /> (12) Failure to submit to a special medical examination <br /> in accordance with Section 23 of this Memorandum of <br /> Understanding or failure to appear at the <br /> designated time and place for such examination or <br /> failure to sign authorizations and/or waivers as <br /> required by the provisions of the City Personnel <br /> Rules. <br /> <br /> (13) Violation of CORPUS Regulations. <br /> <br />Section 22. Grievances <br /> <br />22.1 A grievance is any dispute which involves the <br /> interpretation or application of any provision of this <br /> Memorandum of Understanding excluding, however, those <br /> provisions of this Memorandum of Understanding which <br /> specifically provide that the decision of any City <br /> official shall be final, the interpretation or <br /> application of those provisions not being subject to the <br /> grievance procedure. <br /> <br />Memorandum of Understanding <br />Page 23 <br /> <br /> <br />
