He had already been forced to build a fence to contain his boat. <br /> <br /> Darlene Sewell, 7254 South Valley Trails Drive, indicated she had complied with City <br />regulations by putting the boat behind a fence. The new structure is to protect the boat. The <br />drainage for the structure runs off to the street, not onto the Silvas' property. Also she felt the <br />Silvas' roses had sun by 10:00 a.m. <br /> <br /> Ms. Mohr asked if there were a gutter on the carport? Is it on the edge of the roof or <br />is there a drainage channel? <br /> <br /> Mr. Sewell stated the gutter was installed to run off onto his property, then to the street. <br />He cannot move the carport because the gas meter is in the way. He is willing to put in steel <br />poles to limit the fire hazard. <br /> <br /> Ms. Michelotti asked how wide the trailer was? Was there any place in between that <br />would accommodate the trailer and still give additional space next to the fence? <br /> <br /> Mr. Sewell replied the trailer was eight feet wide. There wasn't more space because <br />of the location of the gas meter. <br /> <br /> Mr. Pico asked if Mr. Sewell knowingly built the carport with the understanding that a <br />permit was needed. <br /> <br /> Mr. Sewell replied he knew he needed the permit but not the variance. He did not find <br />out about the variance until the structure was almost completed. <br /> <br /> Mayor Tarver closed the public hearing. <br /> <br /> Mr. Pico commented that he would like to try and find a way to allow the structure to <br />remain. He felt there were practical limitations on this property with respect to the boat trailer. <br />Since there were similar structures in the neighborhood, he did not feel this was a special <br />privilege. He felt the variance could be conditioned to address the fire and safety requirements, <br />building code requirements, and could be conditioned so that the structure was to be removed <br />when the property was sold. He felt singling out one property owner when other neighbors were <br />not in compliance made him uncomfortable. He felt Council needed to amend the Code or <br />decide that the City should enforce the Code against all non-conforming uses. <br /> <br /> Ms. Acosta commented that the penalty for not taking out a building permit is a double <br />permit fee. This encourages people to get the permit. Lack of a permit is usually discovered <br />when a home sells and the owners have to disclose whether or not a permit was issued for any <br />additions/remodels. <br /> <br />10/03/95 -6- <br /> <br /> <br />
