Mr. Swift stated there is no regulation over the height of a vehicle on a trailer. The only <br />regulation is on the height of a structure. Since the carport is part of the main structure, it can <br />have the same height as the main structure. <br /> <br /> Ms. Mohr questioned if someone had a vehicle and put a removable cover over it, would <br />there be a height limit on that. <br /> <br /> Mr. Swift stated there would be if it were classified as an accessory structure; then the <br />height limit would be 15 ft. if not attached to the main structure. <br /> <br /> Ms. Mohr commented that the Code does not address visual obstructions which are <br />frequent in many neighborhoods. These normally come to the surface when there is a <br />neighborhood dispute. She felt that if the public health and safety issues are met, then the <br />aesthetics is the only issue. It was hard to single out this one case. She asked if there were <br />other choices available. <br /> <br /> Mr. Swift clarified the that the Code change could be changed to allow certain kinds of <br />covers (open on three sides) or other accessory structures. The Code could be amended, but <br />Councils over the years have felt one structure might be fine aesthetically and the next one not. <br />The Code has been changed and fences are now allowed to go eight feet in height. With an <br />eight foot fence or six to seven foot fence with lattice on top, the same rule applies as to where <br />an accessory structure over six feet high can be placed. There may be a way to allow certain <br />types of open carport type structures to come closer to the property line if they meet the building <br />code requirements and if they are below eight feet in height at or just in from the property line. <br /> <br /> Ms. Mohr commented about the inequity of the situation. If someone has a neighbor that <br />doesn't complain, that person can get away with this. She would like the treatment of this more <br />uniform. <br /> <br /> Mr. Swift stated that the over-height fences are subject to administrative design review. <br />The design is usually a key issue. <br /> <br /> Ms. Mohr felt that this particular lot has two lots whose backyards face the side yard as <br />opposed to the more traditional sideyard to sideyard, where there are no windows that look out <br />onto what is stored. <br /> <br /> Mayor Tarver asked if two and a half feet were cut back from the structure would the <br />boat fit. <br /> <br /> Mr. Swift stated that the trailer would not fit. <br /> <br /> Mayor Tarver sought clarification that either the Code had to be amended or the Council <br />need to make the findings for a variance. <br /> <br />10/03/95 -4- <br /> <br /> <br />
