Ms. Michelotti commented that is why the City has a conditional use permit process for
businesses that are questionable.

Mr. Garetz asked if the Council votes for the ordinance as it stands tonight, he would
volunteer to notice the people in that neighborhood and let them know that the second reading
is going to be at the next Council meeting.

Mayor Tarver stated that the City Attorney is not recommending that because the public
hearing is closed and to undo that, someone has to make a motion to reconsider.

It was moved by Ms. Dennis, and seconded by Ms. Mohr, to reconsider the introduction
of Ordinance 1662 and to renotice this matter for the next Council meeting.

The roll call vote was as followS:
AYES: Councilmembers Dennis, Michelotti, Mohr, Pico, and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

Item 7~
Qn-going discussion retarding San Francisco property and Cooperative Planning Process
-- for the San Francisco Water Department - Bernal Avenue Site.

Jack Hovingh, 4250 Muirwood Drive, complimented the Council on forming the
Committee of Decision Makers in trying to resolve the San Francisco Water Department issues
with both Alameda County and City of San Francisco. While the Council advocates holding the
meetings in the City of Pleasanton and that they be televised, he objected to the meetings being
at 10:00 a.m., which makes it impossible for most working people to see. He felt that the
people should be able to come down and see it live. He was also concerned about
Councilmember Pico who advocates running for County Supervisor in this coming election while
he is representing the City on this Board. His perception is that the process will be sullied by
Mr. Pico being a candidate for County Supervisor while acting as a City Council member. He
suggested that Councilmember Pico remove the potential for tarnishing the process by stepping
down and letting Councilmember Dennis take his place.

Mayor Tarver commented that having a meeting at 10:00 a.m. doesn't allow for people
to come to the meeting. The Decision Makers should be available for the public not the other
way around. San Francisco has also changed the designation of who is going to represent it.
It has taken two key people who are responsible for the planning of this plan and made them
decision makers. He believed the decision makers should be elected officials.

Mr. Roush replied that there were incredible efforts to have the meeting scheduled in the
evening when everyone could be there. This upcoming meeting was the only date and time that

09/19/95 -27-
