The roll call vote was as follows: <br />AYES: Councilmembers Michelotti, Mohr, Pico and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br />Item 6a <br />AP-95-5\Z-95-12 Appeal of the decision by the Planning Commission approviml an <br />application for design review approval to construct an approximately 3,956 square foot <br />Commercial building an related site improvements to be located at 780 Main Street, <br />(SR95:236) <br /> <br /> Mr. Brian Swift presented the staff report. <br /> <br /> Ms. Michelotti asked if the $25,000 contribution is the total of the Churkas costs for the <br />improvements to Ray Street. She also asked if those improvements that the City will be doing <br />are in conjunction with development of this site. <br /> <br /> Mr. Swirl stated the applicants would pay $25,000 upon taking out a building permit and <br />they would not have any other obligation for the Ray Street improvement. Mr. Swirl stated that <br />the City should be able to do the Ray Street widening cheaper than any developer because it <br />involves relocating an overhead power pole and the City is normally allowed to do that at no <br />cost through a program that PG&E has. Mr. Swift stated that if the project is approved this <br />way, the funds would be utilized to build the improvements. <br /> <br /> Mayor Tarver stated that he felt the staff report indicated that the project doesn't fit as <br />the best use for that lot downtown and that it doesn't fit with the design review guidelines. <br /> <br /> Mr. Swift stated that these are just guidelines and that staff has tried to incorporate as <br />many as those policies into the design of all buildings downtown. Staff just doesn't feel that this <br />project went as far as it could have. <br /> <br /> Ms. Michelotti stated that she met with the applicant. <br /> <br /> The Mayor opened the public hearing. <br /> <br /> Charles Huff, Architect, 30 West Neal Street, #200, stated that the guidelines suggest <br />that the building be built property line to property line. He stated that the building will be <br />different because there will be gardens at the south end of the site. Also due to the traffic on <br />Ray Street, he felt the building should accommodate delivery trucks coming in, which is why <br />there are two driveways. <br /> <br />07/18/95 -8- <br /> <br /> <br />
