Request for reconsideration

Jim Duncan, 617 Angela Street, stated that at the June 27th meeting it was moved and
seconded to open Mindor Drive with left turn restrictions to and from Bernal Avenue. Mr.
Duncan asked if Council might reconsider its votes since it has now received corrected
information about the situation. He stated that on June 30th he had a conversation with Becky
Dennis and asked what it would take to have her reconsider her vote. Mr. Duncan said
Ms. Dennis stated that the safety issue would have to be satisfied and she felt she would need
an expert. Mr. Duncan then stated he went to the Cal Trans district office on July 3 to see Len
Miller (the person previously mentioned in Becky Dennis' notes regarding Miradot Drive safety
issues). Mr. Miller was on vacation so he talked with the engineer (covering for Mr. Miller)
who was aware of the issue. Mr. Duncan stated that after the engineer found out who he was,
the engineer decided he didn't want to talk with him or get involved with city politics. He was
then taken to the District Chief of Traffic Operations for Cal Trans who stated he was aware of
what had transpired and had sent a fax out clarifying and concurring as to Cal Trans position
and standards. Mr. Duncan said the fax discounts the Mirador notes which the Council
previously received, and in fact the standards don't even apply to the condition as they exist at
the intersection today. Mr. Duncan stated that the Miradot notes are totally inaccurate.

Mr. Duncan stated that the District Chief of Traffic Operations for Cal Trans more than
meets Ms. Dennis' requirements as an expert. Since Ms. Dennis is on vacation, the question
then had to go to Mayor Tarvet and Councilmember Pico to ask if they will reconsider their vote
taken June 27 and support 444 neighbors on this issue since all the agencies responsible for
public safety (Cal Trans, City of Pleasanton Engineering staff, Pleasanton Police Dept., the
latest report of the City of Pleasanton's Engineering and Traffic Survey and Speed Zoning
report) agree on this issue.

Mr. Pico said he would not reconsider the issue.

Mayor Tarver said he also would not reconsider the issue.

Mr. Duncan then asked if the Council will re-examine the issue after six months.'?

Ms. Mohr stated that if there is a request from the neighbors in six months for that item
to be put on the agenda, that could be done at that time with Council approval.

Ms. Acosta stated that if there were concerns or requests about traffic in an area,
normally it first goes to the Traffic Committee for review.

Ms. Mohr then stated that if Mr. Duncan wants to see this come back to the Council in
six months, he should submit the request to the Traffic Committee or to the City.

07/18/95 -5-
