Ms. Michelotti stated she would like the applicant to work with staff and look at the
possibility of putting a gate on the front to allow access Main Street. A motion by
Ms. Michelotti for the front gate access died for lack of a second.

Mr. Swift stated that there is already handicap access to the lower and upper levels of
the decks and access to the main door. Whether a handicap access or step access off Main
Street into the patio could be done to meet handicap regulations and still meet the Churkas'
security requirements is still unknown.

It was moved by Mayor Tarver, and seconded by Mr. Pico, that Resolution No. 95-79 be
adopted, upholding the appeal by the Churkas and approving the design of the proposed building
at 780 Main Street, subject to the conditions in the staff report, as modified by the Council, and
with the additional condition 66.

The roll call vote was as follows:
AYES: Councilmembers Michelotti, Mohr, Pico, and Mayor Tarver
NOES: None
ABSENT: Councilmember Dennis
ABSTAIN: None

Item 6b
PUD~81-30-58D - Applicalion for PUD development plan approval to allow the conSlruC~[i0n
of a one-story, 69,500 square foot office/industrial flex use building on a 5.95 acre parcel,
(SR95:222)

This item was continued to 8/1/95 at the request of Councilmember Pico.

Item 6e
Request to process independently from the General Plan Update a General Plan amendment
for a 2.88-acre site on Stanley Boulevard. (SR95:235)

Mr. Brian Swift presented the staff report.

Mike Madden, Red Bear Incorporated, 5955 Coronado Lane, stated the staff report is
thorough. He hoped he would be able to get started on this project soon since his waiting list
is extensive for these kinds of property.

It was moved by Ms. Michelotti, and seconded by Ms. Mohr, to direct staff to process
the General Plan amendment independently of the General Plan Update.

07/18/95 -16-
