Mayor Tarver asked for an update regarding the Planning Commission decision on this <br /> issue. He then asked if the Planning Commission approved this with the objections of <br /> Mr. Churlca. <br /> <br /> Brian Swift stated that the Planning Commission approved the project over the objections <br /> of Mr. Churka. He felt the issue was a design review issue and that the matter could be <br /> appealed by Mr. Churlca or a member of the Council. <br /> <br /> Mr. Churka stated he did not realize that there was an appeal form. <br /> <br /> Ms. Acosta stated that the form could be picked up in the Planning Department. She <br /> informed Council that the June 20 agenda would not provide time to give notice but it would be <br /> put on the July 18th agenda or an earlier meeting in July. <br /> <br /> Transfer of Sewer Permits <br /> <br /> Pat Mitchell, 3500 Bernal Avenue, explained the circumstances surrounding her sewer <br /> permit and requested Council to consider allowing her to transfer her sewer permit to another <br /> property. <br /> <br /> Ms. Acosta stated that the June 20th agenda already has numerous policy issues on it. <br /> <br />.... Ms. Mitchell stated either meeting in July (if there are 2 meetings) will be fine. <br /> <br /> 6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br /> Item 6a <br /> Status report on the Golden Eatle Farm Geologic Review. (SR95: 187) <br /> <br /> Michael Roush stated that this was continued from the Council's meeting in March, 1995. <br /> At that time the Council adopted a motion to have a Council subcommittee and representatives <br /> of the Golden Eagle Farm Homeowners Association meet to discuss a funding vehicle to address <br /> the Council's on-going concerns about geological studies that had been prepared in connection <br /> with the project. The motion also included that if that were done, nothing further would be <br /> investigated. He stated that the Mayor sent a memo to the homeowners association and <br /> subcommittee explaining why he had supported the motion. <br /> <br /> Mr. Roush explained that the Association then prepared a draft geological abatement <br /> program (GAP). That program has been reviewed with staff, representatives of the homeowners <br /> association, and the subcommittee. The GAP and an amendment to the CC&Rs would provide <br /> the mechanism to fund activity within the Association's boundaries for maintenance <br /> responsibilities so that landslides and erosion hazards would be prevented, abated and controlled. <br /> The Association will provide a geologic consultant to identify where potential hazards could be <br /> <br /> 06/06/95 6 <br /> <br /> <br />
