Barbara Davies Walsh, 2376 Greenberry Ct., urged the Council to give its consent to the <br />rezoning of the Del Prado site. She supports the sale and development of the property and hopes <br />the funds will be applied to improvements for Walnut Grove School. <br /> <br /> Janet Yarborough, 4560 Ewell Ct., who represents the Walnut Grove Elementary School <br />Advisory Committee, urged the Council to rezone the property and let the School Board go <br />ahead with the sale. She felt that it would end up being a detriment to the community to build <br />a school there and put the School District in financial jeopardy. <br /> <br /> Ms. Dennis asked if anyone knew when there will be a decision on how to spend the <br />proceeds from the sale of the Del Prado site. She asked if anyone knew when the District would <br />be making a formal decision. <br /> <br /> Mayor Tarver stated the School Board would be holding its meeting on Tuesday <br />(May 23). <br /> <br /> Frank Berlogar, 2200 Vineyard Ave., stated that he approved the sale of the Del Prado <br />site and he urged the Council to work with the School Board on this issue. He felt the schools <br />are outstanding in Pleasanton. <br /> <br /> Teri Sewall, 5034 Blackbird Way, asked the Council to reconsider the Del Prado issue <br />and rezone it for housing. <br /> <br />6, PUBLIC HEARINGS AND OTHER MATYERS <br /> <br />Item 6a <br />Appeal of a decision of the Harming Commission to uphold the Planning DireCt0r'S <br />determination that Construction of a second unit outside of a PUD building envelope <br />requires an application for a PUD major modification. (SR95:131) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Mr. Sam Raber, 20 Deer Oaks Ct., stated that Council adopted Resolution 93-150 <br />confirming that second units had to be built within the building envelope as established in the <br />PUD for Deer Oaks. He stated that his property has a 350 frontage, which he felt could be <br />used for another building. He believed there is no definition of a building envelope in the <br />building statues and codes. He was told the only way to build outside the building envelope is <br />for a PUD major modification. He would provide any studies necessary to show the proposed <br />building will be stable and will blend into the area. He stated that another property owner in <br />the Deer Oaks area was allowed to build outside the building envelope and questioned why they <br />could, but he hasn't been allowed to build. He feels the Council and the City staff are being <br />unreasonable and are limiting his property even when it has economic consequences.
