4. CONSENT CALENDAR

A1 Wiemken asked to make a comment for the record on Item 4e. This project still
needs PG&E hookups. He stated he met with PG&E to try and work out the system on Trenery
Drive. Everything else was in place.

Pat Nelson, 3652 Shenandoah Ct., asked to address Item 4i. She asked if it were
possible to amend the agreement to allow the septic tank to run its useful life before being
required to connect to City sewer.

Mr. Lum stated that staff could not support such a recommendation. The sewer will
eventually be installed adjacent to the Nelson property. There is a current proposal for a 5 lot
subdivision but the staff has recommended the variance for the septic tank to give the Nelsons
a fall-back position should the subdivision not proceed in a timely manner. When the
subdivision does improve, sewers will be installed and the Nelsons will have to tie into it
immediately and pay the pro-rated share of the sewer. The Nelsons' septic system is interim
and conditional upon tying in to the sewer when it is extended. Because the Nelsons' lot is
smaller than what would normally be allowed for a septic tank, and because the sewer adjacent
to their property is likely to be extended in the near future, they've agreed that as a condition
to obtaining the variance that they would tie into the sewer when it is constructed.

Mr. Nelson indicated the County requires a lot size of greater than 40,000 sq. ft. and his
- lot is greater than 40,000 sq. ft. so it meets the County Health regulations. The Engineering
Department says the lot is smaller, but it's the City ordinance that requires five acres.

Mayor Tarver suggests putting Item 4i after Item 6e for discussion.

It was moved by Ms. Mohr, and seconded by Ms. Dennis, that the following actions be
taken on the Consent Calendar:

a. Approve the City Council Minutes for April 24, 1995.

b. Commend Rick Aguiar.

c. Approve plans and specifications; review of bids and award of contract for the
construction of Sports Park Phase VI, Part I, the Pathway Project, CIP 947043
to Gateway Landscape Construction, Inc. for a low bid of $168,115.20; transfer
a total of $7,530 from completed Park CIP projects to this project in order to
overcome the existing budget shortfall; and authorize the City Manager to enter
into the contract for this project. (SR95: 149)

d. Accept public improvements for resurfacing of various city streets, Project No.
945003A; authorize the City Clerk to file a Notice of Completion for the subject

05/16/95
-2-
