Mr. Tarvet agreed with the comments made by Mr. Pico. He stated it was important
that the neighbors accepted the project, but there are still a few who have objections and would
like to see single story units and other issues of density resolved. Mr. Tarver was most
concerned with the density, setbacks, and size of the units proposed. It was difficult for him
to visualize the units, but it seemed the units will be dense, and high with no setbacks. The
people seem to be satisfied, but he is not sure how attractive or open it will be. He still
preferred single story units and reduced density. He did agree it is an improvement and will
satisfy the neighborhood.

It was moved by Ms. Mohr, seconded by Ms. Dennis, to introduce Ordinance No. 1648,
to be read by title only and waiving further reading thereof, approving the application of New
Cities Development Group, for development plan approval to construct 43 single-family homes
on a 7.6+ acre site generally located at the northwest corner of the St. John Street/Pleasanton
Avenue intersection, subject to the conditions set forth in the staff report, but amending
condition 23 to provide its resolution prior to approval of the tentative map, to investigate
sprinklers on the banks for fire abatement, to investigate a safe pedestrian crossing at the
emergency vehicle access, to preserve trees wherever possible, and amending condition 29 to
have the City assume liability relative to public access to the arroyo but not for the play
equipment and park.
The roll call vote was as follows:
AYES: Councihnembers - Dennis, Michelotti, Mohr, and Pico
NOES: Mayor Tarver
ABSENT: None
ABSTAIN: None

Item 7b
RZ-94-08, City of Pleasanton
Consider amendments to the Pleasanton Municipal Code, the Downtown Specific Plan, and
an established City policy regarding criteria for establishing and locating financial
institutions including banks, savings and loan associations, finance companies, credit
unions, and related services. (SR 95:47)

Brian Swift presented the staff report.

Mayor Tarver declared the public hearing open.

Mr. John de Melo, 337 Main Street, Branch Manager of Bank of America, indicated he
had read the staff report. He expressed his concerns about how the City would deal with
financial institutions that have already located in the downtown area and whether the institution
would be allowed to relocate. He also questioned staff's definition of financial institution and
cited examples not mentioned by staff such as Merrill Lynch, Charles Schwab, GMAC, etc.
He requested the hearing be postponed so that representatives of Bank of America could present

02/07/95
- 20 -
