MINUTES <br /> OF THE <br /> SPECIAL MEETING <br /> OF THE <br /> CITY COUNCIL <br /> <br /> January 24, 1995 <br /> <br />CALL TO ORDER <br /> <br /> Mayor Ben Tarver called the Special Meeting of the City Council to order at 6:25 p.m. <br /> <br />ROLL CALL <br /> <br /> Councilmembers present were Rebecca L. Dennis, Sharrell Michelotti, Karin Mohr, <br />Thomas P. Pico, Jr. and Ben Tarver. Staff members present were: Deborah Acosta, City <br />Manager; and Michael H. Roush, City Attorney. <br /> <br />1~ Agreement with Steve Thomas concerning Color Tile Building Permit. (SR 95:39) <br /> Michael Roush presented the staff report. <br /> <br /> Harvey Levine, 7026 Koll Center Parkway, indicated Mr. Thomas and Color Tile would <br />like to complete the project as soon as possible and requested Council to approve this agreement. <br /> <br /> James Miller, 3633 Camelot Court, indicated his understanding from the meeting of <br />January 17, 1995 was that nothing was approved and there was no agreement with Mr. Thomas <br />to proceed until the expiration of thirty days. Mr. Miller did not object to Color Tile, but <br />objected to the nuisance and noise behind the buildings. He asked if Council is leaving it to the <br />residents to proceed with a referendum or lawsuit? <br /> <br /> Mr. Tarver explained that the Color Tile application was approved on January 17, 1995 <br />with the condition that no access be allowed to the back area. Staff's position at that time was <br />that no building permit could be issued until thirty days had expired because of the possibility <br />of a referendum or other action. The applicant has agreed not to use the back of the building <br />or to sue the City regarding that condition and has requested the City to allow it to obtain a <br />building permit now. <br /> <br /> Ms. Michelotti indicated there will be a little disruption while construction is going on <br />and Color Tile is moving into the center. <br /> <br />01/24/95 <br /> Page 1 <br /> <br /> <br />
