Mr. Tarver wanted to support the Mayors' Conference whenever possible. He requested
authority to take a position and then seek ratification.

Mr. Pico supported giving the Mayor some flexibility on items that are time sensitive.
There was consensus to allow that.

9. SPECIAL AND INFORMATION REPORTS

Item 9a
Actions of the Zoning Administrator (IR 95:07)

Mr. Pico expressed concern about UP-94-77, the Phillips' application for a large daycare
facility. He wanted to be sure the concerns of the neighbors were addressed.

Mr. Swift indicated the City's ability to regulate these facilities is limited by the State.
Past experience with large family daycare homes in neighborhoods has been that they have not
had complaints about operation when conditions are complied with.

Mr. Tarver referred to a League of California Cities resolution regarding licensing of
these facilities by cities. Mr. Roush indicated that was correct, but currently City discretion is
very limited.

No action was required or taken on this item.

Item 9b
PUD-89-14-1D-1M, Craig Sjoberg
Application for a minor modification to PUD-89-14-1D to extend the design review by 2-1/2
years, to June 19, 1997, for the approved office building located at the corner of Heasanton
Avenue and Old Bernal Avenue. (IR 95:06)

Mr. Pico asked what happens if this application is denied. He felt two and a half years
is a long time to extend. Mr. Pico was not happy with some of the signs that appear on this
property.

Mr. Swift explained that approval of the PUD development plan would lapse and the
applicants would have to reapply for development for the office building. The site would remain
zoned planned development.

Mr. Tarver was also not comfortable with the extension. When a project is approved,
it is assumed it will be built. He suggested this be processed as a major modification and he
supported limiting extensions.

01/17/95
10-
