Brian Swift presented the staff report. <br /> <br /> Mayor Tarver declared the public heating open. <br /> <br /> William Hays Weissman, 7901 Stoneridge Drive, Suite 401, said Mr. Morgan has worked <br />very diligently to bring this site into compliance. He has brought it into compliance according to <br />the Fire Department requirements; he has paid the fines that the City has levied against him and he <br />is in the process of attempting to finish complying with everything that the City is requiring. One <br />of the ways he is going to do this is to bring some containers on site temporarily to finish removing <br />the non-complying equipment off site. Mr. Morgan agrees with staffs recommendations. He does <br />not want to continue with a piecemeal, temporary approach. He has decided to submit a final <br />approval. The staff report lists two ways he can achieve this. Option No. 4 asks for Council to <br />approve the use and send the design back to the Planning Department or for Council to approve a <br />modified use on a temporary basis for twelve months, while the plans goes through the Planning <br />Commission. He believed that a plan for a final project could be submitted to the Planning <br />Commission within 90 days. He said a design would be submitted for a limited, modified use up to <br />twelve months until a final building could be constructed. Once the final building is constructed, <br />the house that is now currently on the property would be removed. Mr. Morgan does not want the <br />property to look like a junkyard. The non-compliance is with the party rentals and one of the <br />concerns is the noise from trucks moving on and off the property at all hours. He indicated that <br />trucks do not have to visit the site that often. He said the medical use, that is allowable, would <br />remain on site. Eventually the party rentals will be removed from the site. He felt going for a final <br />solution was in the best interest for both the City and Mr. Morgan. <br /> <br /> Mayor Tarver asked how could the findings that are required be made. <br /> <br /> Mr. Weissman said the findings could be found based on Table 18.44.090 in the Municipal <br />Code which states that hospital equipment sales and rentals, laundry and dry cleaning services, <br />storage buildings for household goods are all permitted uses. He indicated there is no other <br />business in the Tri-Valley area that provides this type of service. He believed this is a necessary <br />service. <br /> <br /> Russ Morgan, 3878 Stanley Boulevard, would like the site to look like a business site. He <br />has tried to do this with the temporary trailers. He would rather make the house permanent because <br />it would look more professional. On a temporary basis he would like to paint the house that is <br />currently on the site, move the containers for the party rentals off the site and then submit a design <br />for a permanent structure. The business provides oxygen, which is a necessary service. He <br />explained the reasons he had to do both medical supplies and party rentals. He said in order for the <br />medical business to survive he had to do the party rentals. He was willing to move the party rentals <br />off site, but would like to be able to display what he has available in the house.
