Item 6g <br />Request to extend growth management (Oak Tree Farm, Phase lIB. (SR96:354) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Patrick Currin, 272 Sassafras Court, representing Oak Tree Farm, indicated this was the <br />third phase of the PUD. Phase I and II have approved final maps. Phase I is 99 % complete <br />and Phase II has 50 % of its underground infrastructure in place. The third phase is part of a <br />PUD. As of January 1, 1996, more than half of Phase I was unsold and Phase II was not yet <br />released. To add the remaining fourteen lots would have been economically unwise. He <br />believed it was now appropriate to begin building Phase HI for sale in late 1997, as Phase II <br />starts selling now. If necessary, they would be willing to pay the building fees in advance if it <br />will save the growth management allocation. <br /> <br /> Peter MacDonald, 400 Main Street, representing the Curtins, explained that without the <br />six month extension of growth management, the approved PUD plan will expire and the Currins <br />will have to reapply under a new set of growth management program rules that will make it very <br />difficult to get approval for the final fourteen units. There has been substantial progress on this <br />development and Oak Tree Farm has proceeded in good faith based on the 55 unit PUD. <br />Numerous public improvements have been installed including roads and a pump station on <br />Foothill and the project includes an open space conservation easement based on 55 units. <br />Additional geological studies have been done by three geologists at the City's request. He did <br />not think it was fair or legal for a PUD to be allowed to expire when a developer is so far into <br />his project. Oak Tree Farm is not asking for any special treatment with respect to the City's <br />geologic requirements. The issue is the validity of the remaining fourteen lots. If a six month <br />extension is granted, that issue can be determined on its merits. <br /> <br /> It was moved by Mr. Pico, seconded by Mr. Tarver, to adopt Resolution No. 96-143, <br />denying the request for an extension of the growth management for Oak Tree Farms, Phase <br />llI. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 6h <br />Ordinance Providing for Stabilization of M0bileh0me Space Rents.
