He reiterated the need for the Mall's expansion and pointed out <br /> that the Planning Commission had recently approved a major office building without <br /> consideration of the West Las Positas interchange. Unless Council enacts a moratorium on all <br /> land use decisions, he felt it was appropriate to proceed on the basis of the General Plan as it <br /> currently exists but continue to review the impacts of removing the West Las Positas <br /> interchange. <br /> <br /> Mr. Pico asked if the residents who have been involved regarding the West Las Positas <br /> interchange had been notified. <br /> <br /> Ms. Acosta said no. <br /> <br /> Mr. Tarver did not feel this discussion should continue unless those people are made <br /> aware of this issue. <br /> <br /> Jeff Brinton, Brobeck, Phleger & Harrison, counsel for Wells Fargo Bank, clarified the <br /> obligations of Wells Fargo Bank for traffic improvements, which were included in the 1990 <br /> PUD approval. He summarized that clarification of the reimbursement agreement as it related <br /> to the PUD was necessary. About a year ago, when discussions were held regarding the N'PID <br /> surplus, it was determined appropriate to modify the reimbursement agreement and staff also <br />- suggested extending the term of the reimbursement agreement. Wells agreed to extend the <br /> agreement and at the same time requested a similar extension to the Development Agreement <br /> and Sewer Agreement so that everything tracks together. Nothing has changed since that time. <br /> <br /> Mr. Pico asked the Taubman representatives whether they would agree to a condition that <br /> stated the expansion square footage would only be allowed upon a final decision to build the <br /> West Las Positas interchange. If a decision is made not to build the interchange, then Taubman <br /> would have to reapply for any additional square footage. He wanted to find a way to allow <br /> Taubman to continue to develop the project at reasonable levels, but also gives the City the <br /> flexibility to continue to work with the neighborhood and to pursue the West Las Positas <br /> interchange study. He encouraged Taubman to participate in that process. <br /> <br /> Avner Naggar, 601 Gateway Boulevard, South San Francisco, architect for Stoneridge <br /> Mall, and Senior Vice President of the Taubman Company, reiterated that the Taubman <br /> Company and the City of Pleasanton are "partners". The Mall brings many benefits to the City, <br /> riseally and otherwise. The Center needs the flexibility to strengthen the Center and to offer a <br /> prospective tenant the opportunity to be a pan of the Center. He was concerned that if there <br /> are conditions imposed, a prospective tenant will go elsewhere. He believed further study was <br /> necessary before agreeing to any new conditions being imposed. Traffic is the lifeblood of any <br /> Center and if a customer cannot find a parking place or have easy ingress/egress, he will go <br /> elsewhere. <br /> <br /> Mr. Gibney referred to the discussions regarding the West Las Positas interchange and <br /> asked if the City were contemplating some kind of building moratorium on new project <br /> <br /> 14 12/03/96 <br /> <br /> <br />
