Mr. Tarver did not like the process being followed. He felt there was a major change <br />in the application and revision to the conditions and there should be notice to the public of the <br />changed application. He did not like Council making significant changes to applications. <br /> <br /> Ms. Mohr commended the architect on a good design for downtown and did not believe <br />that the interior use or design was relevant to this Council decision. She felt there was enough <br />information to make a decision. <br /> <br /> It was moved by Ms. Mohr, seconded by Ms. Dennis, to adopt Resolution No. 96- <br />117, making a f'mding of de minlmls impact and approving a negative declaration for this <br />project. <br />The roll call vote was as follows: <br />AYES: Councilmembers- Dennis, Mohr, and Pico <br />NOES: Mayor Tarver <br />ABSENT: None <br />ABSTAIN: Councilmember Michelotti <br /> <br /> It was moved by Ms. Mohr, seconded by Ms. Dennis to adopt Resolution No. 96-118, <br />approving the application for design review for the project with the upstairs use being office <br />and conditions 4, 5, 41, 46 and 87 being modified accordingly. <br /> <br /> Ms. Dennis remarked that normally she would agree that a significant change would <br />require going through the Planning Commission again, but she believed the same comments <br />would be made regarding office versus residential use. The real issue is parking and that will <br />come back anyway. She did not want people to have to spend more time going over this again. <br /> <br /> Mr. Pico suggested an amendment to the motion to add a condition that the in-lieu <br />parking fee be calculated assuming 50 % of the ground floor retail will be restaurant use. <br /> <br /> Ms. Mohr asked whether this would affect the other downtown buildings when a use <br />changes to restaurant. <br /> <br /> Mr. Swift said that staff could calculate the fees as requested. Uses in the commercial <br />areas of downtown change all the time. What is a restaurant today may be a retail store next <br />month and vice versa. It would be extremely difficult to track changes in parking fees. <br /> <br /> Ms. Mohr accepted the amendment. <br /> <br /> Mr. Tarver reiterated his position that not enough progress had been made with regard <br />to parking.
