Ms. Michelotti felt that 6-8 months ago this applicant was dealing with a different density <br />range, and she did not know how you achieve a 1/2 acre per unit as an infill project in <br />downtown. <br /> <br /> The applicant was advised by Mr. Tarver that this item would be heard again at the <br />September 3rd meeting when Ms. Dennis would be in attendance; she will be able to review the <br />video tape of the meeting as well as the meeting minutes. <br /> <br /> There was a break at 9:50. <br /> <br /> The meeting reconvened at 10:00 p.m. <br /> <br />The next item was moved up on the agenda. <br />Item 6f (formerly Item 4d) <br />Approval of plans and specifications and award of contract for Pleasanton Aquatic Center, <br />Pro_iect 947038. <br /> <br /> Dolores Bengtson presented the staff report. <br /> <br /> In response to Mayor Tarver, Ms. Bengtson advised that the Park and Recreation <br />Commission did not hear any objections on the award of the aquatic center contract. <br /> <br /> Roger Nelson, 1180 Holm Road, Petaluma, President of Midstate Construction <br />Corporation, advised that his company was the second lowest bidder as outlined in the staff <br />report. He is protesting the award of this contract to Ralph Larsen & Sons. Mr. Nelson advised <br />that his bid was approximately $1,300 higher than the Ralph Larsen & Sons bid. In review of <br />the bid, however, Mr. Nelson found Ralph Larsen to be substantially non-responsive on key <br />issues, i.e., issues that revolve around the Public Contracts Code and City specifications. Each <br />bidder is to conform to the Standard Specification, Section 3104 of the California Public <br />Contract Code. The bidder is to provide the subcontractor's name for work that is either <br />$10,000 or 1/2 of 1% of the total bid proposal (which is $16,000 for this contract). Ralph Larsen <br />& Sons did not do this. Ralph Laxsen listed two subcontractors to do landscaping. Mr. Nelson <br />stated that by law, if two contractors are listed to do one item of work, the bidder is obligated <br />to do the work himself. Also, if no subcontractor is listed, the contractor must perform the <br />work. This work could be done with a California B-1 license; however, the City's <br />Specifications require the landscape contractor to possess a State of California Landscape <br />Contractor License. Mr. Nelson advised that Ralph Laxsen does not have such a license. The <br />landscape contract amount is approximately $80,000 and Mr. Nelson understands that Ralph <br />Larsen intends to do the work himself. <br /> <br /> Mr. Nelson continued, the Metal Fences and Gates section had no one listed as a <br />subcontractor. The City's Specifications require five years' experience in such work, and Mr. <br />Nelson advised Ralph Larsen does not have five years experience. This could be done with a <br />B-1 license, but it fails to meet the City's specifications. Further, the bid contract specifies that <br />the subcontractor's name, address, phone number and whether they are an individual, <br />partnership or corporation must be listed in the bid proposal.
