Express delivers to neighborhoods everyday. He felt the ordinance needs further review. He <br />does not want to prohibit gun sales in Pleasanton. He has heard no complaints about firearms <br />dealers and has had heard no support in support of this legislation. He had concerns about <br />Pleasanton establishing rules regarding Saturday Night Specials when they are allowed to be <br />manufactured in the state. He had too many questions and issues that need to be addressed <br />before pursuing this further. He is an accountant and he cannot have his business in his home. <br />The City regulates piano teachers and other businesses in the home and gun dealers should not <br />categorically be exempt from that control. However, the laws should not be so stringent that <br />people are driven out of business. He also heard statements about State regulations that provide <br />immunity from civil liability. If that is the case, how does that relate to our requirements at the <br />local level? He felt Council should proceed with caution and should get more information on <br />what is appropriate for Pleasanton. <br /> <br /> Ms. Michelotti was not in support of a copycat ordinance. It has to be right for <br />Pleasanton. She does not like guns and would not have one in her home, but that is her personal <br />feeling. The right to bear arms and protect yourself has been established since the inception of <br />this country. She can see value in investigation of a conditional use permit, but it seems there <br />are already strict regulations for people who deal with firearms. She would like to talk to the <br />Police Chief and others in law enforcement. She preferred to have this issue tabled until she <br />can get more information. She knows nothing about the whole list of guns and cannot judge <br />which one should be allowed and which not. She realizes there is a safety issue regarding <br />certain guns. She felt this issue is low on Council's priority and should be deferred pending <br />further information. <br /> <br /> Mr. Pico referred to a comment from his wife that much of the legislation at the State <br />and Federal level is a result of grass roots support from local jurisdictions and activities of <br />citizens requesting regulation. <br /> <br /> Mr. Bocian indicated the staff report was reviewed by the Police Department and the <br />Department was involved in drafting the ordinance with the City Attorney. If Council wants <br />additional information, that can be obtained and members of the Police Department can be at <br />future Council meetings. <br /> <br /> Mr. Tarver also indicated he does not like guns but he respects a person's right to bear <br />arms. He is not trying to exercise gun control. The concept of dealing with a problem was <br />introduced at a Mayors' Conference. He understood the issue to be primarily one of cheap, <br />poorly made guns that were too readily accessible to kids and are used frequently in crimes. <br />He thought good points were made at that time. He was told that the Penal Cede requires the <br />City to have a permitting process. The purpose of this staff report was to adopt a resolution of <br />intention and to authorize spending money to defend legal challenges with the rest of the cities <br />as discussed at the Mayors' Conference. That does not mean we are just accepting an ordinance <br />presented to Pleasanton. If there are rational judgments to be made, Council will make them. <br />There is a process including Planning Commission hearings, staff analysis, Police Department <br />review, public testimony.
