Mr. Tarver felt discussion usually deals with a developer who doesn't get growth <br />management approval. In the proposed policy, can a resident bring a lawsuit against the City <br />because it exceeded growth management allocations established in the General Plan. <br /> <br /> Mr. Roush indicated anyone can bring a lawsuit, but the defense would be that even <br />though there are 800 units in the queue, they are not all new units and therefore are not truly <br />in excess of what the General Plan permits. <br /> <br /> Ms. Mohr was pleased with the suggestion to postpone the final decisions. Meeting twice <br />a week and trying to keep up with all the material has made her feel pressured. She felt taking <br />the time to make sure that Council decisions are valid and defensible was worth a couple of <br />weeks. <br /> <br /> Ms. Michelotfi agreed. It has been difficult cross-referencing all the documents and she <br />needed to review the minutes of July 9. <br /> <br /> Mr. Roush suggested a meeting on August 5 instead of August 6, because the regular <br />agenda is very full. <br /> <br /> Ms. Mohr felt the August 6 agenda should be reviewed to see what items were time <br />sensitive and continue the remainder. She preferred having a meeting on a regular meeting night <br />because that would have the largest audience. <br /> <br /> Ms. Dennis suggested a workshop in between because there seems to be more issues that <br />need discussion. <br /> <br /> Mr. Bocian felt that if Council planned to hold regular business on August 6 in addition <br />to the General Plan discussions, it will be difficult. He was also concerned that some time is <br />necessary to get the additional legal opinion. <br /> <br /> Mr. Tarvet then suggested July 29 as a workshop forum or special Council meeting. He <br />did not think it was wise to continue all the items on the regular agenda for August 6. <br /> <br /> There was discussion about the availability of each councilmember. <br /> <br /> Ms. Michelotti asked exactly what will be done on August 5. <br /> <br /> Mr. Tarvet suggested Council go through the issues tonight that were raised at tonight's <br />meeting, discuss them again and give staff direction. On August 6, Council would take final <br />action on the EIR and the General Plan. He wants a legal opinion about growth management, <br />the urban growth boundary, and a housing cap. If those are put on the ballot, he wants to make <br />sure it is appropriate and has been checked every way possible and that any legal challenge can <br />be defended. <br /> <br />07/15/96 <br /> - 19- <br /> <br /> <br />
