It was moved by Mayor Tarver, seconded by Ms. Mohr, to add Program 4.6 to the <br />Circulation Element, page HI-29, to read as follows: "Maintain the interim two-and three- <br />lane cross-section for Foothill Road as specified in City Council Resolution No. 91-23, for <br />as long as feasible, and widen Foothill Road to four lanes only if and when there is no other <br />reasonable alternative." <br /> <br /> Ms. Michelotti asked for clarification. If this program says there will not be a four-lane <br />road, what happens to the right-of-way reserved for four-lanes on Mr. Kliment's property? <br /> <br /> Mr. Swift indicated the City would still keep the right-of-way, and there would be a <br />wider area of landscaping maintained by the City. Some potential right-of-way could be taken <br />from Mr. Kliment's property if the city was required to go to a four-lane configuration. The <br />interim alignment does not take any property from him. <br /> <br />The r011 call vote was as follows: <br />AYES: Councilmembers- Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Ms. Michelotti indicated that because Mr. Kliment is not available to speak to this on <br />July 15, can he speak to this tonight or should he put something in writing. <br /> <br /> Mr. Kliment was pleased that staff agreed with his recommendation to keep Foothill Road <br />a two and three-lane road. He felt the last wording still leaves the threat of condemnation on <br />his property and the Starns' property. <br /> <br /> Mr. Tarvet believed that if the right-of-way language is removed from the General Plan, <br />then a future owner could build on the area that may be needed for a future expansion of <br />Foothill Road and the City will pay more for the property when necessary. <br /> <br /> Mr. Beougher stated that was correct. <br /> <br /> Mr. Kliment felt that the General Plan could be changed in the future. With regard to <br />the price of the property, the City would pay the fair market value of the property regardless <br />of whether the fight-of-way was already there or not. <br /> <br /> Mr. Kliment believed that he could not do anything with his property because of this. <br />He can't build up to Foothill Road because of the Overlay Districts. <br /> <br /> Mr. Beougher indicated Mr. Kliment can do anything with his property so long as it is <br />consistent with the existing zoning. <br /> <br />07/09/96 -35- <br /> <br /> <br />
