No date was set for the consideration of the matter. <br /> <br />Item 61~ <br />Status Report on LAVWMA/EBDA Negotiations - Review of Preliminary Reports on <br />Exp~n~iQn P!annin_~ and Direction to LAVWMA Renresentatives. (SR96:224) <br /> <br /> Randall Lum presented the staff report. <br /> <br /> Mayor Tarver felt the important points were: whether to continue with the attempt to <br />put a measure on the ballot; whether to accept a sunset provision as to the in~uent limitation; <br />whether the call a special election of it is impossible to get a measure on the November 1996 <br />ballot; and what pipe size to use if further repairs are necessary. He requested Council to give <br />the LAVWlVIA representatives enough direction so that they do not have to come back to <br />Council repeatedly. He indicated the letter from Union Sanitary further complicates matters <br />because it will apparently veto any agreement that does not have a sunset clause. It does not <br />appear there is an agreement. If DSRSD agreed the pipe size is acceptable and the sunset clause <br />is not necessary, or could be reviewed at a later date, it is possible agreement could be reached. <br />He indicated it may be possible to modify the LAVWMA Joint Powers Agreement to provide <br />unanimity concerning the sunset provision which would then allow LAVWMA to accept the <br />EBDA agreement, but it would be at LAVWMA's discretion whether to sunset the limitation. <br /> <br /> Ms. Mohr referred to the staff report which indicated Union Sanitary would not accept <br />the agreement with an in~uent limitation; it does not refer to the sunset clause. Are there two <br />conditions Union Sanitary will not accept.'? <br /> <br /> Mr. Tarver indicated his belief that DSRSD is calling the shots and Union Sanitary is <br />supporting DSRSD's position. If DSRSD ever decides it can agree with Livermore and <br />Pleasanton, Union Sanitary would accept the agreement. <br /> <br />07/09/96 -2- <br /> <br /> <br />
