Mr. Tarver summarized that there is a process for requesting a rent increase, but we <br />don't know whether that has been followed because there is no information on how the rents <br />were calculated. <br /> <br /> Mr. Roush said if the information is not forthcoming through tenant inquiries or through <br />the Committee process, there might be a finding by the Committee that the rent was not <br />calculated correc~y, and there would be a presumption the ordinance was violated. Staff would <br />then follow up on that. He explained what happens once the Committee is convened. <br /> <br /> Mr. Burton preferred that there be a special session of the City Council in lieu of <br />convening the Committee. <br /> <br /> Mr. Roush explained that the City Council has no direct oversight of the Committee. <br />If Committee decisions are not complied with, an appropriate court action could be filed. <br /> <br /> Ms. Michelotti felt it was appropriate to convene the Committee because it doesn't appear <br />that anything will happen until that occurs. <br /> <br /> Mr. Roush doubted that the Committee will get the information any quicker. <br /> <br /> Mr. Tarver felt it might be necessary to review the ordinance, since the Committee has <br />no ability to enforce cooperation. He agreed it is time to have the Committee meet. <br /> <br /> Mr. Roush will convene the Committee as quickly as possible. The Committee has been <br />successful on other occasions. <br /> <br /> Ms. Dennis requested a review of the Committee minutes to see if there is any way the <br />Council can be of assistance. <br /> <br /> Bert Felix, 2860 Garden Creek Circle, complained about the watering of the median on <br />Stoneridge Drive. He suggested watering for shorter periods of time more frequen~y to prevent <br />the overflow in the streets. <br /> <br /> Mr. Lum indicated the medians are maintained by the Hacienda Business Park Owners <br />Association. Staff has been working on the problem for some time. The problems occur <br />because of the way the medians were constructed and the fact that there is an old irrigation <br />system. Staff has found some short-term solutions with regard to replacing some of the heads <br />and adjusting water pressure, but is still working on the long-term solution to the problem. <br /> <br /> Kay Ayala, 4515 Gatetree Circle, referred to a report dated 5/29/95 from Chris Bourg <br />to the Council acknowledging the public interest regarding the downtown. The Steering <br />Committee unanimously made the following recommendation: The Land Use Element policy <br />3, program 3.1 should be modified to read, "preserve the character of downtown while <br />improving its retail and residential viability and preserving the design and traditions of the small <br /> <br />07/02/96 -6- <br /> <br /> <br />
