Ms. Mohr arrived at this time. She indicated she had talked to the appellant earlier and <br />had driven by the home to look at the tree. She knew she would not be able to stay at the <br />meeting long, so she had watched testimony on television. <br /> <br /> It was decided the vote could be retaken to allow Ms. Mohr to participate. <br /> <br /> It was moved by Mayor Tarver, seconded by Ms. Dennis to adopt Resolution No. <br />96-09, upholding the appeal and requiring the Gilmores to plant a 24" box tree in the place <br />of the tree that is removed. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Dennis, Mohr, and Mayor Tarver <br />NOES: Councilmembers Michelotti and Pico <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Ms. Acosta indicated handling these matters on a case by case basis is not advisable, <br />because staff must be able to inform people at the counter whether they can remove a tree. <br />Amending the ordinance is not necessarily a high priority, but it should be considered in the <br />future. <br /> <br /> It was moved by Ma. Michelotti, seconded by Ms. Denn[% to direct staff to review <br />the heritage tree ordinance so this kind of appeal may not be necessary in the future. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item <br />Letter of Aereement for Bernal property following ltction Of the Committee of Decision <br />Makers on December 12. 1995. (SR 96:13) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Mayor Tarver wanted discussion by Council before hearing public testimony. He further <br />indicated he had a change of heart based on discussion with the community. He felt the majority <br />of the community wants Plea~_nton to stay involved and to participate in the joint process. He <br />did not like the process and resisted participation. He now feels it is necessary to have a plan <br />the community can support instead of dividing people. He appreciated the calls he has received. <br />Considering all the legal options and other alternatives, he feels the best alternative is to go <br /> <br />01/16/96 -6- <br /> <br /> <br />
