3, ACjENDA AMENDMENTS

Mayor Tarver requested that Item 4k, the second reading of Ordinance No. 1731,
approving the application of Ponderosa Homes (PUD-96-10), be continued to the meeting of
January 6, 1998. He felt it was not fair to require the citizens to mount a referendum during
the holidays.

Ms. Ayala believed that Ponderosa has abided by all the rules and regulations and has
agreed to all the delays the City has requested; therefore, she did not agree with this delay. She
objected to this use of the Council rules. She felt that if there were a continuance, it should be
only to December 16, not to January 6.

Ms. Michelotti also objected to the continuance and felt this was setting a precedent with
regard to a second reading of an ordinance. She urged the Mayor to reconsider his request or
consider the suggestion of Ms. Ayala.

Mr. Pico supported the continuance to January 6. One of the reasons for having the
Council meeting on December 9 instead of December 16 was concerns about the Christmas
holidays and conflicts with the holiday season. He felt it was a disservice to the community to
force a referendum during this period. He suggested an agenda item for Council to consider
putting the item on the ballot as an initiative, without requiring the citizens to collect signatures.

Ms. Dennis indicated she had been involved in a referendum during a holiday season and
she did not feel this would keep people from being successful. She agreed that a week between
meetings was an unusual circumstance and she would be willing to continue the item to
December 16. She had hoped that those people who were talking about a referendum might
reconsider because she felt this was not a justified referendum in that the project is consistent
with the General Plan.

It was moved by Ms. Dennis, seconded by Ms. Ayala, to continue Item 4k, the
second reading of Ordinance No. 1731 to an adjourned regular meeting, to be held on
December 16, 1997 at 5:00 p.m.
The roll call vote was as follows:
AYES: Councilmembers- Ayala, Dennis, and Michelotti
NOES: Councilmember Pico and Mayor Tarvet
ABSENT: None
ABSTAIN: None

Pleasanton City Council 12/09/97
Minutes 2
