Ms. Michelotti suggested working together to determine where the best placement would <br />be for additional screening. <br /> <br /> Ms. Battershell said if one more screen were added the roof would not need to come off. <br /> <br /> Mayor Tarver explained that if Mr. Broyer removed the top, there would be no need for <br />design review and this public hearing. That situation would be worse, as the roof does provide <br />partial screening. <br /> <br /> Ms. Battershell hoped to setfie this tonight. She mentioned that the CC&R's say no <br />structures can be above the fence line; therefore, she could take this to court. <br /> <br /> Ms. Ayaia asked how many other properties would be affected if she were to go to court <br />and how many other properties had structures that went over the fence line? <br /> <br /> Ms. Battershell said if she took this to court, it would not affect anyone else. There are <br />a lot of play structures in the area. She mentioned she has heard complaints against these <br />structures, but because the structures are below ten feet, the city could not do anything. <br /> <br /> Ms. Ayala asked if all the neighbors were opposed to the structure? <br /> <br /> Ms. Battershell said no. <br /> <br /> Ms. Ayala asked how many children Mr. Broyer had? <br /> <br /> Ms. Battershell said one. <br /> <br /> Alan Crawley, 6724 Corte Del Vista, said he bought his house for privacy. The only <br />people that would be able to see into his yard is someone that would be in the Broyers' <br />structure; therefore he felt his privacy was being violated. He said there are no rules that <br />address such structures. He felt the structure's only purpose was for a child to sit in and stare <br />at people. He would like to propose that Council address such structures and change the law. <br /> <br /> Molly Crawley, 6724 Corte Del Vista, said she likes to entertain, swim and garden in <br />her back yard, but now feels she is being watched. She suggested that Mr. Broyer come to her <br />yard and see what she is talking about.
